New Chief Justice De Castro must prove 'independence, impartiality'
'The new Chief Justice will have to credibly address uncomplimentary views about her independence and impartiality,' says the National Union of Peoples' Lawyers
MANILA, Philippines – Newly-named Chief Justice Teresita Leonardo De Castro faces the challenge of proving her independence and impartiality, a lawyers' group said on Saturday, August 25.
The National Union of Peoples' Lawyers (NUPL) said in a statement that De Castro "will have to credibly address uncomplimentary views about her independence and impartiality."
"We need a leader who inspires and who commands respect and admiration. The bar, bench and the public need to trust the system and its symbols amidst the trials and tribulations," the NUPL added.
President Rodrigo Duterte picked De Castro over fellow SC Associate Justices Lucas Bersamin and Diosdado Peralta to head the High Court on Saturday, August 25.
De Castro was among the 8 SC associate justices who voted for the ouster of Chief Justice Maria Lourdes Sereno through a quo warranto petition.
Opposition group Tindig Pilipinas criticized De Castro's appointment, claiming it was a "concession" for Sereno's ouster.
In a Facebook post, the group said the appointment was a "reflection of how Duterte played with the country's justice system and his propensity to use government posts as a reward for his loyal followers."
Tindig Pilipinas also pointed out that De Castro will only be serving for two months as she was due to retire in October.
"Thus, exiting from the judiciary being a Chief Justice, with all its perks and privileges, and for having served the court the 'shortest' period on the record," it said.

Senator Richard Gordon, chairman of the Senate Blue Ribbon committee, said Saturday the appointment by President Duterte of Supreme Court Associate Justice Teresita Leonardo de Castro as Chief Justice is “well-deserved.’’
“It is a great reward for those who have been there for a long time. All of them (Associate Justices) are qualified,’’ Gordon following reports that President Duterte picked de Castro from a shortlist of three candidates drafted by the Judicial Bar Council (JBC).
Gordon said he knows de Castro could handle the issue of shortages of courts as she could discuss this specific problem and other needs of the Judiciary with President Duterte she being the President’s choice.
He stressed that de Castro “has a good record’’ at the Supreme Court where she started as a clerk.
Gordon, a member of the JBC, said he and his other classmates had prayed for the appointment of de Castro as the Chief Justice.
De Castro is a 1972 University of the Philippines law graduate.
Her two-month tenure at the High Tribunal will end on Oct. 10 upon reaching the mandatory retirement age of 70.
She is the second most senior Associate Justice at the Supreme Court.
The other two in the JBC shortlist of three potential Chief Justice were Associate Justices Diosdado Peralta and Lucas Bersamin.

Solons say De Castro appointment reward for role in Sereno ouster
At least two congressmen on Saturday said Teresita Leonardo-De Castro's appointment as the new chief justice was her reward for the supposed part she played in the ouster of her former colleague, erstwhile Chief Justice Maria Lourdes Sereno.In a statement, Albay Rep. Edcel Lagman claimed the appointment was President Rodrigo Duterte's "reward" to De Castro for her "starring role" in unseating Sereno, who was kicked out of the high tribunal after Solicitor General Jose Calida's quo warranto plea was granted.In her concurring opinion, De Castro had maintained Sereno's appointment as top judge in 2012 was invalid.Lagman said De Castro's tenure, which would only last for less than two months or until her retirement in October, "militates against her appointment.""With the very short period of her incumbency, it is humanly impossible for her to accomplish wonders or anything of substance in the Supreme Court," he said.Lagman was among the House lawmakers who earlier lodged an impeachment complaint against De Castro and six other SC associate justices who voted to oust Sereno."De Castro should have seriously considered declining her nomination and refusing her impending appointment as chief justice of the Supreme Court considering the seriousness of the impeachment complaint against her for culpable violation of the Constitution and betrayal of public trust," he said.Like Lagman, Magdalo party-list Rep. Sereno camp mum on De Castro’s appointment as chief justice
Published August 26, 2018 4:58pmThe camp of former Supreme Court Chief Justice Maria Lourdes Sereno has no comment on the appointment of Teresita De Castro as the new top magistrate.
"CJ Sereno has no comment on recent developments in the SC," attorney Jojo Lacanilao, one of Sereno's spokespersons, said in a text message to GMA News Online.
On Saturday, Justice Secretary Menardo Guevarra announced that President Rodrigo Duterte had chosen De Castro as the new chief justice.
The announcement came only two days after impeachment complaints were filed against De Castro and six other Supreme Court justices over Sereno's ouster.
De Castro was one of eight justices who voted to grant the quo warranto petition filed by Solicitor General Jose Calida, which questioned the validity of Sereno's appointment as top judge.
De Castro will occupy the top post for only 41 days. She will be obliged to retire on her 70th birthday on October 8. —

MANILA - The House justice committee next week may start impeachment proceedings against Chief Justice Teresita De Castro, just days after her appointment as the country's top judge, a congressman said Monday.
Opposition congressmen last week sought the removal of De Castro and 6 other justicesfor ousting former Chief Justice Maria Lourdes Sereno through a quo warranto petition that allegedly usurped Congress' power to take out impeachable officers.
The impeachment complaints against the 7 justices are expected to be referred to the House justice committee when Congress resumes session on Tuesday, said panel chairman Mindoro Rep. Doy Leachon.
"If it will be referred to us tomorrow, mga September 4, Tuesday next week, we'll start with the hearing on the impeachment complaint," he told radio DZMM.
"I would like to sure everyone, especially the complainants as well as the respondents, that we will deal with this complaint transparently (and) without partiality," he added.
Albay Rep. Edcel Lagman, one of those who filed the impeachment complaint, earlier expressed hope that De Castro's appointment as Chief Justice can still be reconsidered given that Malacañang has yet to release her appointment papers.
De Castro, 69, is the second woman to serve as chief justice after Sereno, whose appointment to the high court invalidated last May for failure to fully disclose her wealth.
De Castro is the most senior member of the Supreme Court and has served in government for 45 years. She was presiding justice at the Sandiganbayan anti-graft court before she joined the top court.

Duterte defends De Castro appointment as chief justice
Published August 27, 2018 9:29amPresident Rodrigo Duterte on Monday defended the appointment of Teresita Leonardo de Castro as chief justice of the Supreme Court amid allegations it was her reward for her supposed role in unseating Maria Lourdes Sereno from the helm of the high tribunal.
Duterte said De Castro's appointment was based on seniority, a tradition that was broken in August 2012 when then-President Benigno Aquino III named Sereno, a junior magistrate, to the top judicial post.
"Kung sino 'yung nauna pumasok, siya 'yung unang ma-promote and that would go for everybody," Duterte told reporters after he led the National Heroes' Day celebration at the Libingan ng mga Bayani in Taguig City.
"I am not familiar of any of them actually. Wala akong kilalang justice na 'yung personal. Truthfully, I have not talked to anyone there. Wala akong kilala. They are all strangers to me."
Opposition lawmakers Edcel Lagman and Gary Alejano on Saturday claimed that the appointment of De Castro was Duterte's incentive for her part in unseating Sereno.
Lagman said De Castro should have seriously considered declining her nomination and refusing her appointment because of her role in removing Sereno from power.
De Castro is one of the SC magistrates who Sereno wanted, in a failed attempt, to inhibit from deciding the ouster petition against her.
De Castro figured in a heated exchange with Sereno during the oral arguments in April on Solicitor General Jose Calida's petition for quo warranto as she questioned Sereno on the filing of her Statements of Assets, Liabilities and Net Worth.
She also testified in the House justice committee's hearings on the impeachment charges against Sereno, saying at one point that the latter's appointment as top magistrate was a "grave injustice" to the other applicants, including herself.
De Castro and seven other justices later voted to oust Sereno on the ground of lack of integrity, citing her incomplete submission of asset statements when she applied for the post.
The 69-year-old De Castro will go down in the country’s history as the chief justice with the shortest stint in office, as she will only serve for less than two months.
She will reach the mandatory retirement age of 70 on October 8.That record previously belonged to the late Pedro Yap, who was at the helm of the SC for 72 days or from April 19, 1988 to June 30, 1988.
