    Lacson says forensics should have been used in Recto Bank probe

     

    Senator Panfilo Lacson on Sunday said authorities should have conducted forensics in investigating the Recto Bank incident involving Chinese and Filipino vessels.

    "Sa totoo lang, tapos na ang isinagawang imbestigasyon ng PCG [Philippine Coast Guard] at Marina [Maritime Industry Authority]. Pero nagsagawa ba sila ng forensics?" he asked during an interview on Dobol B sa News TV.

    "Hindi dapat sapat na testimonya lang. Dapat nagsagawa sila ng forensic doon sa tinamaan. Makikita po kasi kung gaano kalakas ang impact at kung sideswiped," he added.

    The PCG and Marina have recommended that Filipino fishermen be better informed and trained in the wake of the Recto Bank incident last June 9. 

    Officials of both the Department of Transportation—the agency that oversees the PCG—and Marina did not give details however as regards their findings and the contents of their report which was submitted to President Rodrigo Duterte.

    Lacson also said the bigger issue is that the Chinese crew left the 22 Filipino fishermen at sea after their boat (Yuemaobinyu 42212) bumped into the FB Gem-Vir 1.

    "Ang mas importanteng usapin ay hindi tinulungan... Maliwanag na lumulubog ang fishing vessel. Bakit hindi nila tinulungan?" he said.

    "Hindi pa nga natin alam kung fishing vessel nga ito o armed maritime militia," Lacson added.

    The senator also lamented that the matter was called a "little maritime incident" because no one died.

    "Pero hindi ito little incident dahil tahimik lang na nangingisda ang mga kababayan natin doon," he added.

    Lacson however lauded the government for helping the affected fishermen and giving them financial assistance.

    The senator also admitted that despite the Constitution saying that the exclusive economic zone should be protected for the benefit of Filipinos, it is difficult to prevent other countries from fishing there.

    "Ang sinasabi ng Constitution na ang 200 nautical miles EEZ ay dapat protektahan at para sa mga Pilipino pero hindi natin kayang bawalan ang ibang bansa na mangisda diyan," Lacson said.

    The senator added that the issue of territory may take a long time to resolve.

    "Ang usapin na ito goes beyond President Duterte, [Foreign Affairs] Secretary Locsin, Secretary Panelo. That will outlive their term," he said.

    "Matagal talaga itong isyu na ito at maaaring hindi tayo makakita ng resolusyon," Lacson said.

    Meanwhile, on the issue of impeaching Duterte after he said China would not discontinue fishing in the country's EEZ "because we're friends," the senator said this may not be possible.

    "Sa tingin ko, hindi puwedeng i-impeach ang Pangulo kaugnay sa pagpayag ng pangingisda sa mga Chinese sa EEZ dahil wala naman official act," he said.

    Presidential Spokesman Salvador Panelo says the Philippines will still 'suggest' the inclusion of a neutral country in the joint inquiry, if China and the Philippines have conflicting findings on the Recto Bank incident

    MANILA, Philippines – China has rejected President Rodrigo Duterte's suggestion of involving a "neutral" third party in the Philippines-China joint investigation into the sinking of a Filipino boat by a Chinese ship, Malacañang said on Monday, July 1.

    Quoting the report of Philippine Ambassador to China Chito Sta Romana, Panelo said, "Ang sabi naman nila (China), huwag na 'yung third party, kailangan tayo lang mag-usap doon (China said, no more third party, let's keep the discussion between us)."

    "For them, it's not necessary because if you already agree, then what's the point? They have a point," Panelo said in Filipino at a Malacañang news briefing on Monday.

    Panelo said Sta Romana based his report on his discussions with China's foreign ministry. The Duterte spokesman said he received this report on Sunday, June 30.

    What China now wants, said Panelo, is for the Philippines and China to continue their current separate investigations and then form their own "task forces" which will "meet" to compare the findings and then "resolve all the issues raised."

    It was Duterte himself who suggested the inclusion of a representative from a neutral country in a "joint investigating committee." Apart from the neutral member, the committee the President suggested was to be composed of "3 groups of highly qualified and competent individuals," with the Philippines and China to have one representative each.

    What's Philippines' stance? The Philippines, however, will still "suggest" a third party if there would be conflicting results of the countries' separate probes.

    "We will suggest. If the findings are not consistent, can we look for a third party?" Panelo said.

    Panelo downplayed the possibility of a clash in findings of the two governments. "I think there will be no serious disagreement because they said we need to resolve this right away," he said.

    The Duterte spokesman echoed the Chinese foreign ministry's supposed words that were dismissive of the need for a third party.

    "But they (China) said, we don't need that (third party). There's nothing we can't resolve," said Panelo.

    Panelo reiterated that the Philippine government still expects China to impose sanctions on the captain and crew of the Chinese ship for abandoning the Gem-Ver fishermen at sea.

    "I trust the assurance of the Ambassador of China that they will not allow that. If there was irresponsibile behavior, they will sanction that," said the Duterte spokesman.

    Panelo described the boat sinking incident as an "ordinary nautical navigation incident," in contrast to his repeated assertions that Filipinos should be more "circumspect" when making conclusions about the controversy pending the results of an official investigation.

    The findings of the joint probe of the Philippine Coast Guard and Marina was submitted to Malacañang on June 20 or 11 days ago. Malacañang has yet to make its findings public.

    The military's Western Command (WesCom) has its own probe into the incident.

    PCG-Marina report pins down China crew; raps pushed



    MANILA, Philippines — The government should file cases against the Chinese vessel that caused the sinking of the Filipino fishing boat Gem-Ver 1 and then abandoned its 22 crew members in the open sea, Sen. Sherwin Gatchalian said after details of an official report on the incident were made public on Saturday.

    “The fact is very clear that they were left there and they almost died, and they didn’t receive help from the one who hit them … In other words, we need to get justice for our fishermen and use this report,” Gatchalian said in a radio interview.

    The case could be filed in a Philippine court because the incident took place within the Philippines’ 370-kilometer exclusive economic zone (EEZ), he added.

    According to the June 20 investigation report by the Philippine Coast Guard (PCG) and the Maritime Industry Authority (Marina) sent to President Duterte, the Chinese vessel that smashed into the anchored Filipino fishing boat not only failed to take measures to avoid hitting it but also willfully left the 22 Filipinos struggling for their lives in the water.

    ‘Direct knowledge’

    The Chinese vessel maneuvered back to about 50 meters from the stricken boat, a move which indicated that the Chinese crew had “direct knowledge of the distress situation,” the report on the June 9 incident near Recto (Reed) Bank said.

    But instead of saving the crew of the Gem-Ver 1, the Chinese vessel turned off its lights and sailed away, it said. The Filipinos were rescued hours later by a Vietnamese fishing boat.

    By this action, the Chinese vessel failed to provide assistance to distressed persons at sea in violation of regulations under the UN Convention on the Law of the Sea and the International Convention for the Safety of Life at Sea, the report said.

    It said the incident happened about 259 kilometers northwest of Piedras Point in Palawan province, in “vicinity waters” of the Recto Bank and well within the Philippines’ EEZ.

    It said the weather then was “fair with starry skies,” visibility “was slightly clear” and the sea was calm.

    Prevent a repeat

    Gatchalian said he wanted to prevent a repeat of the incident, and this would be avoided if those involved would be held accountable.

    “If they see that the government’s response is weak, if we won’t file cases or go after those who hit the fishermen, the incident will be set aside and it would be repeated,” he added.

    The report did not say whether the Chinese vessel intentionally rammed Gem-Ver 1, calling the incident an “allision”—a ship hitting another that is stationary.

    The Chinese vessel destroyed a portion of the stern of the Gem-Ver 1, causing water to flood its hull and sink the boat.

    Sen. Panfilo Lacson said he was wondering if the joint probe conducted a forensic examination of the damage to determine whether the ramming was accidental or deliberate.

    “If not, that explains why the report is inconclusive and incomplete in that regard. I would say, that should be an important aspect of the investigation,” said Lacson, a former national police chief.

    ‘Soft’ handling

    The Joint Marina-PCG Marina Safety Investigating Team concluded, however, that in accordance with definitions set by the Code of the International Standards and Recommended Practices for Safety Investigation of a marine incident, that it was “a Very Serious Marine Casualty (event) due to the total loss of the ship.”

    Mr. Duterte had dismissed the Gem-Ver 1 sinking as a “little maritime accident” and the result of a “miscommunication.” That has triggered criticism of his “soft” handling of the incident.

    The PCG-Marina report only referred to the Chinese boat as “unidentified Chinese fishing vessel” and not the trawler Yuemaobinyu 42212 identified by the Chinese Embassy in Manila or a ship belonging to China’s maritime militia.

    “Based on the description and drawing of the [boat captain], as corroborated by the rest of the survivors … it can be considered that the vessel that hit FB Gem-Ver is similar to the Chinese fishing vessels seen fishing in the area,” it said.

    The report, however, said the Gem-Ver 1 and its crew were not compliant with some maritime and fishing regulations, chief of which was the failure to designate a lookout who “could signal an alarm of any approaching danger.”

    Unlicensed officer

    The boat also had an unlicensed chief engine officer, carried more people than its authorized capacity and had an expired fishing and gear license and clearance certificate.

    It said the crew reported maintaining anchor and white flashing lights, but the investigators could not determine whether their illumination was in accordance with the required intensity.

    The report said the joint investigation was carried out to “make appropriate safety recommendations and/or adopt measures to prevent the occurrence of similar marine casualty and incident” and “not to seek to apportion or determine liability.”

    The PCG and Marina recommended the formulation of a policy “defining the area of operation and safety standards for fishing vessels” and to keep reminding boat owners, operators and crew about regulations at sea.

    It also called for improvements on the safety of fishing vessels and crew by requiring navigation and communication equipment, voyage data recorder, training and qualification for the crew of fishing vessels.

    Request to China counterpart

    It also suggested cooperation with the Department of Science and Technology to develop local and affordable navigation equipment, such as automatic identification systems and voyage data recorders.

    The report also requested that the Chinese Maritime Safety Administration be asked to conduct its own investigation of the incident.

    In response to the disclosure of the details of the PCG-Marina report, Foreign Secretary Teodoro Locsin Jr. said on Twitter on Saturday: “Its credibility is unimpugnable for being done and issued separately.”

    “Let China make its case,” he said in a separate tweet.

    “I reject any proposal for a joint investigation let alone joint conclusion needing Chinese officials coming over to investigate something done to us in our territory. Ping [Lacson] said, ‘Different if a Chinese was hurt.’ But no, we were hurt in our territory,” he added.

    Senator Richard Gordon said that President Rodrigo R. Duterte should “keep quiet” on issues concerning China’s aggressions in the West Philippine Sea.

    In an interview over DZBB’s Dobol Bantay Balita sa Senado on Sunday, Sen. Gordon stressed that the president should let his men in the National Security Council (NSC) to handle the overall situation.

    “I am out of turn, the president should keep quiet. I think he should let Locsin, Lorenzana to speak, he should let our National Security Council. Kailangan mag-consult ang presidente sa NSC every month,’ Gordon uttered.

    He also said that China’s aggressive behavior towards Filipino fisherfolks in the disputed region cannot be considered as “friendly acts” which President Duterte thinks otherwise based on his positive pronouncements to this superpower nation.

    “Dapat sasabihin natin sa kaibigan natin ‘di makatao ang ginagawa mo. Dapat matuto ang China na kakasahan sila ng ‘Pinas, diplomacy pero ‘pag umabot sa giyera diyan na papasok ang allies natin,” he said.

    The senator even suggested that the president should consult a think tank or a policy institute so that foreign policy experts can analyze verbal agreements entered to by the two states supposedly allowing Chinese to fish within the exclusive economic zone (EEZ) of the Philippines following the Recto Bank incident.

    “Huwag muna siyang (President Duterte) magsasalita, silang dalawa ni Xi Jinping (China) pwede sila magbolahan, kailangan ipakita muna ng presidente ang kasunduan,” Gordon added. (Shane Juan)

    MANILA, Philippines — Public satisfaction with President Duterte rose to a new record high in the second quarter of the year, according to the latest poll conducted by the Social Weather Stations (SWS).

    The survey, taken from June 22 to 26, found 80 percent of adult Filipinos satisfied and 12 percent dissatisfied with the performance of Duterte, for a net satisfaction score of “very good” +68.

    The remaining nine percent of 1,200 respondents were undecided with regard to the President’s performance.

    Duterte’s latest net satisfaction score surpassed the previous record of +66, also very good, in March 2019 and June 2017.

    The two-point increase in Duterte’s net satisfaction rating from March 2019 to June 2019 was due to an increase in the rest of Luzon, offset by declines in Mindanao, the Visayas and Metro Manila, the SWS said.

    His net satisfaction rating stayed very good in balance Luzon, at a new record high +65 (78 percent satisfied, 13 percent dissatisfied) in June, up by nine points from +56 (73 percent satisfied, 17 percent dissatisfied) in March. It also surpassed the previous record of very good +60 in December 2016.

    It stayed excellent in Mindanao, at +81 (88 percent satisfied, eight percent dissatisfied), although down by seven points from the record-high +88 (92 percent satisfied, five percent dissatisfied).

    Duterte’s rating remained very good in the Visayas, at +66 (77 percent satisfied, 12 percent dissatisfied) in June, although down by three points from +69 (81 percent satisfied, 12 percent dissatisfied) in March.

    It also stayed very good in Metro Manila, at +59 (73 percent satisfied, 14 percent dissatisfied) in June, despite dropping by two points from +61 (76 percent satisfied, 14 percent dissatisfied) in March.

    The SWS classifies net satisfaction ratings as +70 and above, “excellent”; +50 to +69, “very good”; +30 to +49, “good”; +10 to +29, “moderate”; +9 to -9, “neutral”; -10 to -29, “poor”; -30 to -49, “bad”; -50 to -69, “very bad”; -70 and below, “execrable.”

    In urban areas, Duterte’s net satisfaction stayed very good, at +67 (79 percent satisfied, 12 percent dissatisfied) in June 2019, up by five points from +62 (77 percent satisfied, 14 percent dissatisfied) in March 2019.

    His net satisfaction in rural areas also remained very good, at +68 (80 percent satisfied, 11 percent dissatisfied) in June, although down by one point from the record-high +69 (81 percent satisfied, 12 percent dissatisfied) in March.

    By socio-economic class, the President’s net satisfaction rating stayed very good in class E, at a new record-high +68 (81 percent satisfied, 13 percent dissatisfied) in June 2019, up by 10 points from +58 (74 percent satisfied, 16 percent dissatisfied) in March 2019. This surpassed the previous record of very good +67 in June 2017.

    It was still very good in class D or the masa, maintaining the record-high +68 in June (79 percent satisfied, 11 percent dissatisfied) from March (80 percent satisfied, 12 percent dissatisfied).
