    Lacson says Panelo acting like defense lawyer of China


    MANILA, Philippines — Presidential Spokesperson Salvador Panelo is acting like the “defense counsel of China” when he doubted the statements of the Filipino fishermen who were rescued after their fishing boat was rammed by a Chinse vessel in the West Philippine Sea, Senator Panfilo Lacson said Wednesday.

    ’Yung statement na nakakita agad siya [Panelo] ng butas doon sa pahayag ng mga fishermen parang ang mindset niya, defense counsel na nag eenter ng appearance for China if he was in a courtroom, ganun ang dating,” Lacson said in a Kapihan sa Senado forum in Pasay City.

    “Subliminal ‘yun eh, para sa akin. ‘Yung kanyang reaction kaagad, ‘nakakita ako ng butas, so walang kasalanan yung China.’ Ang expression na ganun, parang ang dating kaagad parang defense counsel siya ng China,” he added.

    Lacson chided how Panelo gave a “premature conclusion” saying the Palace official’s statement “injected doubt” on the accounts of the Filipino fishermen even though the investigation has yet to be completed.

    Lacson hit back at Panelo, who earlier described as “reckless and premature” the senator’s suggestion to invoke the Philippines’ Mutual Defense Treaty with the United States over the ramming incident.

    “Siya pa nagsasabi hindi pa kumpleto ang investigation. What he is accusing the critics, yan din ginagawa niya,” the senator said.

    “Sabi niya premature pero siya rin premature ang kanyang conclusion kasi nag-inject siya ng doubt sa mga pahayag ng mga fishermen,” he added.

    The boat captain of F/B Gem-Vir 1, Junel Insigne, claimed that their boat was deliberately rammed by a Chinese vessel, however, the boat’s cook said he was unsure if that was the case, as earlier revealed by Agriculture Secretary Emmanuel Piñol.Panelo said such conflicting accounts could put the statements of Filipino fishermen in question.

    “Kasi parang may conflict ‘yung kapitan at ‘yung cook. Kasi tingin ng kapitan, sinadya. Tingin ng cook, mukhang hindi nakita (It appears that there’s a conflict with the accounts of the cook and the captain. The captain said it was intentional. The cook said it may not be deliberate),” Panelo earlier said in a Palace briefing.

    The presidential spokesperson then urged for a formal inquiry in order to get to the bottom of the issue.

    “Kaya kailangan imbestigahan na talaga natin (We need to investigate). Formal inquiry na kailangan dito (It requires formal inquiry),” he said.

    The Chinese government had claimed that the incident was not a case of “hit and run” as the Chinese vessel was besieged by seven or eight Filipino boats.

    Defense Secretary Delfin Lorenzana earlier reported that a Filipino boat sank at the Recto Bank in the West Philippine Sea on June 9 after a “collision” with a Chinese vessel. However, he said the Chinese vessel abandoned the Filipino boat and left the fishermen “at the mercy of the elements.”

    Meanwhile, the owner of the Vietnamese vessel that rescued the 22 Filipino fishermen finally spoken up about the matter.

    Fifty-four-year-old Ngo Van Theng, the owner of the TGTG-90983-TS fishing vessel, said he was able to reach out to the boat captain Nguyen Thanh Tam through radio to give his side of the story.

    The Vietnamese boat captain’s account appeared consistent with the stories of the Filipino fishermen on how they tried to stay afloat and how the Vietnamese rescued them.

    Gordon tells China to own up to its mistake in Reed Bank incident

    MANILA (UPDATE)—Two senators on Wednesday disagreed with Beijing's statement that the incident involving a Chinese ship and a Filipino fishing boat near Reed Bank was not intentional.

    Chinese Foreign Ministry Spokesman Lu Kang on Monday said the incident was "only an accidental collision between fishing boats at sea."

    In a statement, Sen. Richard Gordon urged China to admit its fault, citing an October 2011 incident in which a Philippine Navy warship accidentally rammed a Chinese fishing boat in the West Philippine Sea.

    “It is not difficult to admit one’s fault,” he said. “Stating there were no reports of damage or casualties in the incident, the Philippine government immediately sent an apology to the Chinese embassy in Manila to avoid creating further tension. China could have done this, too.”

    Gordon said China violated the United Nations Convention on the Law of the Sea (UNCLOS) when its vessel left behind 22 Filipino fishermen after sinking their boat.

    "The issue is people are not supposed to be abandoned at sea. Whether it is an accident or intentional collision, is beside the point. The crux of the matter is you left the fishermen in peril of the sea," Gordon said.

    "Under the UNCLOS, it is everybody’s duty to rescue people at sea whether it’s peacetime or wartime regardless of nationality. Whenever there is an incident at sea, the first responsibility is to rescue."

    Gordon earlier said Manila could seek the extradition of the Chinese crew.

    Sen. Nancy Binay, meanwhile, said the incident could not have been accidental.

    “Mahirap paniwalaan na aksidente ’yung nangyari dahil maraming beses na itong nangyari di lang sa mga Pilipinong mangingisda, at alam ng ating Navy ’yan. Ang nakakalungkot lang, China's statements have overshadowed the testimonies and first-hand accounts of the crew," Binay said.

    "Malinaw sa UNCLOS ’yung duty to rescue. We should call out the Chinese government for abandoning our fishermen. We should seek accountability. Kung tatanggapin na lang natin itong isang aksidente, we just showed the world how we take care of our people."

    The Chinese embassy in Manila earlier said the captain of the Chinese ship tried to save the Filipinos but was "afraid of being besieged by other Filipino fishing boats."

    A maritime law expert, however, said satellite data contradict China's claim.

    President Rodrigo Duterte on Monday urged calm over what he described as a "maritime incident."

    Sen. Panfilo Lacson on Tuesday said Duterte “left us heartbroken” with his remarks.

    “He forgot to explore all resources available before exercising his last option of surrender,” he said.

    The incident happened within the Philippines 200-nautical-mile exclusive economic zone in the South China Sea, which is being claimed almost entirely by China.

    Regional police chief admits lapse in deploying personnel in full gear to boat captain's home

    The deployment of policemen in riot gear to the house of the boat captain in the Recto Bank incident was a mistake, the Region IV-B (MIMAROPA) police chief said Wednesday.

    PBGen. Tomas Apolinario told CNN Philippines that members of the Civil Disturbance Management unit — which handles riots, public disturbances and demonstrations — were sent to the house of Junel Insigne in Occidental Mindoro for the visit of high-level officials.

    "That's just precautionary measures and they wanted to have a private talk so we just made sure that it's going to be private," he said.

    The regional police chief said additional personnel were sent with Agriculture Secretary Manny Pinol and Energy Secretary Alfonso Cusi as they extended assistance to the 22 fishermen left adrift in Recto Bank on June 9.

    "What we deployed there were security personnel because two secretaries — Secretary Pinol and Secretary Cusi — will be arriving there. So we just deployed some area security," he said.

    Apolinario said equipment such as shields and helmets brought ny policemen were not used.

    "We can put on standby but it should have not been brought out," he said.

    He added these were removed after the people near Insigne's house raised their concerns.

    Apolinario also assured the public has nothing to worry about.

    "The public shouldn't be alarmed pagka may nakitang ganoon [when they see that]. In fact, they should feel more safe na nandoon 'yung PNP o 'yung AFP [that the AFP or the PNP are present]," the police chief said.

    A Chinese vessel rammed F/B GEM-VER near Recto Bank on June 10. The Chinese crew abandoned the Filipinos, forcing the local fishermen to stay afloat in the cold sea for almost three hours before a Vietnamese vessel passed by to rescue them. This is the latest reported incident of harassment of Filipino fishermen in the West Philippine Sea, a portion of the South China Sea within the country's exclusive economic zone.

    The Department of National Defense (DND) on Wednesday announced that a Chinese fishing vessel sank an anchored Philippine fishing boat with 22 Filipino crewmen near Recto Bank in the West Philippine Sea, then left the scene.

    Penetrante said Filipinos were then rescued by a Vietnamese boat that came within minutes.

    He added: "Kung titingnan n'yo po sa incident report, may intentionality e, kasi hindi tumigil na po (If you look at the incident report, there's intentionality, because it didn't stop.)

    According to Penetrante, the Western Command will conduct an inquiry to pin down the details of the collision for possible filing of a diplomatic complaint.

    Defense Secretary Delfin Lorenzana earlier called for diplomatic action against China after the incident. Hours later, Foreign Secretary Tedoro Locsin Jr said he will "take cue" from Lorenzana's call.

    Changing narratives make a fishy story

    Let us go back to the original version of this story when it first broke out in the media.

    While the Filipino nation was observing our Independence Day last June 12, Department of National Defense (DND) Secretary Delfin Lorenzana broke the news that about 22 of our fishermen on board the F/B Gem-Ver nearly perished at Recto Bank located at West Philippine Sea. The Recto Bank is one of the islets located near South China Sea where our country has overlapping territorial maritime claims with Beijing and other country claimants around this area.

    Lorenzana disclosed that the Filipino fishing boat F/B Gem-Ver figured in a “collision” incident with a Chinese-flagged vessel, but that its 22 Filipino crewmembers were safely rescued by a passing Vietnamese ship. The Recto Bank is nearest to Palawan where the Western Command (Wescom) of the Armed Forces of the Philippines (AFP) is stationed.

    “We denounce the actions of the Chinese fishing vessel for immediately leaving the incident scene and abandoned the 22 crewmembers to the mercy of the elements,” Lorenzana said. The incident took place Sunday evening, June 9 but according to Lorenzana, he got the incident report from Wescom only on the night of June 11.

    The defense chief was in Lanao del Sur with President Duterte to celebrate the country’s 121st Independence Day when he got the Wescom incident report. Actually, Lorenzana had to cancel his scheduled guesting in my Kapihan sa Manila Bay on that day when he was summoned by President Duterte to come along with him to Lanao where they led the Independence Day rites there.

    Days later, the Chinese embassy in Manila confirmed there was such an incident involving one of their fishing vessels and identified it as Yuemaobinyu 42212. But the Chinese embassy also claimed that the still unidentified ship captain of Yuemaobinyu 42212 decided to leave behind their victims when about six to seven Filipino fishing boats swarmed their steel-hulled ship. But Beijing promised to conduct its own investigation into this incident.

    Fortuitously, Lorenzana reset his guesting at the Kapihan sa Manila Bay at a time that this incident has generated national outrage. Quoting from the incident report, Lorenzana noted the F/B Gem-Ver was anchored at the time when it was hit by the moving Chinese fishing vessel. Thus, Lorenzana clarified it was a case of “allision,” not collision. “I had to google it just to know the term ‘allision’ because it was also my first time to encounter such word,” he quipped. 

    In a no-holds barred discussion during our Kapihan sa Manila Bay breakfast news forum, Lorenzana disclosed the Wescom did the initial investigation and processing of the facts gathered from the Gem-Ver ship captain and crewmembers. The Wescom subsequently turned over their report to the Philippine Coast Guard as the proper agency to further conduct the investigation.

    According to Lorenzana, the ill-fated Gem-Ver is actually the mother ship while there were 19 smaller boats or bancas they use for line fishing. All their catch are then transferred to Gem-Ver and put in ice storage. From the testimony of the Gem-Ver cook who was the only one awake and saw the incoming Chinese vessel, Lorenzana quoted him as saying he woke up their ship captain who tried but failed to restart the engine of their fishing boat to avoid it.

    The captain, or the skipper of the fishing vessel F/B Gem-Ver finally realized how fortunate they were to survive following their rescue. The realization dawned on Junel Insignea after they had a closed door meeting with government officials led by Department of Agriculture (DA) Secretary Emmanuel “Manny” Piñol.

    The meeting took place last Wednesday at the hometown of the Gem-Ver fishermen in San Jose, Occidental Mindoro where they were brought by Philippine authorities after their rescue.

    Also present in that meeting was Department of Energy Secretary Alfonso Cusi as the Cabinet Officer for Regional Development for Region 4 that included the province of Mindoro. Both Piñol and Cusi first declared it was just a ”maritime accident” after conducting their respective initial inquiries into this incident.

    Piñol and Cusi reported their findings and recommendations in the meeting at Malacanang by the Cabinet Cluster on national security. Chaired by Lorenzana, the meeting was precisely convened to take up this Recto Bank incident on orders of President Duterte.

    Thus, it was only last Monday when President Duterte commented on the incident at the anniversary of the Philippine Navy held in Sangley, Cavite. The President echoed the findings of the Cabinet Cluster it was a “maritime accident” that should not escalate into a full- blown war with China.

    Naturally, Insignea and his fellow Gem-Ver fishermen deplored what seemed to them were unsympathetic statements from the President and the entire Philippine government.

    But after they were able to talk directly with Piñol et.al, Insignea sort of changed tunes. He now believes it was really just an accident. But Insignea demanded justice be done against his Chinese counterpart skipper for sailing away and leaving them at the mercy of the sea.

    At the end of their talks, the 22 fishermen received 11 new fiberglass-made fishing bancas from the Bureau of Fisheries and Aquatic Resources (BFAR). The BFAR is one of the DA attached agencies.

    The 30-footer fishing boats are equipped with engine and nets, and complete accessories like life vests. Two fishermen will share the fishing boats while their damaged wooden-hulled fishing vessel Gem-Ver is undergoing repair. In addition, all 22 Gem-Ver fishermen will get financial assistance to tide them over while recovering from their traumatic sea mishap.

    Criticized for a tamer version of this sea accident, Lorenzana retorted: “I think we can change our mind if new facts will come in.”

    Lorenzana described it as plain “stupidity” if anyone would not accept the new facts as they unfold.

    Now, the poor fishermen are the ones being accused of changing their narratives into a fishy story after receiving “bribe.” Correction, it was government assistance.

    Metro Manila (CNN Philippines, June 14) — President Rodrigo Duterte on Friday said there is no need for war or even a "convoluted argument" with China over last week's sinking of a Filipino boat in the West Philippine Sea.

    A Chinese vessel hit and sank a Filipino fishing boat near Recto Bank, also known as Reed Bank, an underwater feature being claimed by both Manila in Beijing, on June 9. Duterte reiterated that it was a "maritime incident or accident."

    "It is not a confrontation of armed men and machines or ships. Wala ngang namatay (Nobody died)," he said in a speech in Davao City. He stressed that war is not an option.

    All 22 Filipino fishermen on board the boat F/B Gem-Ver were rescued by a Vietnamese fishing vessel hours after floating in the high seas.

    "At tsaka that is not the proper (action)... Wala namang namatay e," Duterte said. "China says, kung kasalanan nila, magbayad sila. Why do we have to go into a convoluted argument?"
