J1 Visa

Hi ka-PEx! i don't know if this question was already raised. Anyway, I just need to know some information regarding J1 visa. I was recently offered by a US company to sponsor me for an internship in the US under J1 visa. As per US visa site and my program host oeganization, after the program or the internship I need to go back home in the Philippines. Is there a way i can immediately change from J1 visa to H1B or other visa so i can apply for a green card without the 2 year requirement to go back home? or impossible na yun? Base kasi kay google, pwede daw mag apply ng green card ang J1 visa holder. I don't know if it's real. According to my program sponsor, di daw ako pwede magconvert to other visa because it might subject to violation of terms and condition, ipapadeport ba ako nyan just in case nagchange ako ng ibang visa? nasa terms and condition kasi namin na kailangan umuwi ng pinas after my program. TIA

May collateral ba? Kasi nung ojt ko sa US, may collateral kami, so need talaga namin bumalik sa Pinas after the program.

pwede lang mag-change kung walang restirction and exchange program mo. may waiver ka kasing pipirmahan na nag-a-agree ka sa terms ng program bago ka issue-han ng visa. so magiging technically legal contract sya. kung may restriction wala kang choice, uuwi ka talaga. otherwise pwede ka ma-ban from going back to the US.

pwede ka mag-apply for tourist visa at bumisita sa US ulit after ng program, pero until matapos mo yung 2 year home residency hindi ka pwede for any type of working visa or immigrant visa (kahit nga finacee visa hindi pwede). hindi nawe-waive yun.

take note ang restriction ay you need to go back to the phiilippines and stay for a collective two years (meaning hindi consecutive, basta total two years). pero kung kunyari after J1 program bumalik ka sa pilipinas ng 1 year tapos nag-trabaho sa singapore ng 2 taon ,hindi counted sa two years home residency requirement yung 2 taon mo sa singapore. yung 1 year lang sa pilipinas ang counted so kailangan mo pa rin mag-stay ng isa pang taon sa pinas bago ka ma-issue-han ng any type of working visa sa US.
  • Hi! please help me po. I applied for a j1 visa, okay naman lahat ng papers ko. Pero yung first try ko denied 214(b) kasi sa DS2019 mali yung field of study, sa DS160 ko yung sa relatives na part 'None' yung answer ko, pero na slip of the tongue ako. Nasabi ko na US citizen yung grandparents ko pero since 2015 dito na sila naka tira sa Philippines. 2nd try ko ok na lahat ng documents pero denied parin, yung sa Relatives na part 'None' yung answer ko kaso may nakaretain pala na info about sa grandparents ko, so denied ulit pero during those 2 interviews hindi sinabi kung ano yung rason. Can I still get a j1 visa on my 3rd try? What should I do po?

    Thank you.
