The Bureau of Customs (BOC) on Wednesday said it was running after property developer New San Jose Builders Inc., which allegedly failed to pay taxes for importing construction materials when it built the Iglesia ni Cristos (INC) massive Philippine Arena.
In a statement, the BOC said it transmitted a smuggling complaint to the Office of the Solicitor General on Tuesday.
Customs Commissioner Nicanor E. Faeldon also told reporters that New San Jose Builders tax dues had reached P1 billion for importing construction materials even as it invoked the tax-free perks under Republic Act No. 9593 or the Tourism Act of 2009. The law gives away incentives to firms within tourism enterprise zones.

Subject to rules and regulations, Section 86 of the law provides that registered enterprises shall be entitled to an exemption of 100 percent of all taxes and customs duties on importations of capital equipment. The section also described capital investments and equipment necessary for various kinds of tourism enterprises.
Faeldon claimed, however, that their tax-exemption was neither approved by the Department of Finance (DOF) nor the Bureau of Internal Revenue but they still pushed through with their importation.
The BOC said the construction firm availed of the privilege when it imported construction-related items from 2012 to 2013. The Philippine Arena in Malolos, Bulacan, touted as the countrys biggest coliseum, is INCs centerpiece in its 75-hectare complex called Ciudad de Victoria.
They [San Jose] only used a surety bond, so its irregular. When their bond expired and was to be forfeited, we wrote them five times but they did not answer us, Faeldon added.
Since it supposedly does not have a certificate of exemption from the DOF, Faeldon said New San Jose Builders was required to post such bonds in covering the duties and taxes for the shipments.
It posted bonds amounting to P947,292,025.72 issued by Centennial Guarantee Assurance Corp. (CGAC), Intra Strata Assurance Corp. (Isac) and Philippine Fire and Marine Insurance Corp. (PFMIC), according to the BOC.
These three surety companies were included in the BOCs complaint against New San Jose Builders.
Demand letters were sent by the district collector of the Port of Manila (POM) to San Jose, CGAC, Isac and PFMIC in 2015. On July 28, 2015, the district collector sent a final demand letter to the surety companies.

After repeated demands, the acting chief of the POMs bonds division recommended the forfeiture of the bonds on Dec. 1, 2015.
The POMs law division also subsequently recommended the forfeiture of the matured bonds in a memorandum dated Sept. 20, 2016, the BOC said.

Iglesia interference
Sevilla related that his troubles at the BOC started when he was just warming up to his new post one year and four months ago. He specifically mentioned the indigenous Christian congregation Iglesia ni Cristo (INC) that purportedly wanted its own people in key positions in the agency.
In June last year, the BOC released new guidelines on promoting personnel. According to Sevilla, he wanted to strictly implement the process put in place when promoting BOC officials. However, some groups were lobbying for certain personalities to be promoted, ignoring established procedures.
In September or October last year, he said he received feelers that the INC was pushing the appointment of Teddy Sandy S. Raval, chief of the BOC intellectual property rights division, to head the enforcement and security services (ESS).

NEWS: QC court rules INC has right over 36 T. Sora property, bars entry of unauthorized persons

A Quezon City court on March 7, 2017 partially granted the INCs petition for injunction filed almost two years ago. The court recognized the INCs ownership of the property and issued an injunction barring the entry of unauthorized individuals from entering the said property. (Eagle News Service)
(Eagle News) The Quezon City regional trial court on March 7 issued a decision upholding the Iglesia Ni Cristos rights over its property at no. 36 Tandang Sora Avenue in Quezon City, ruling that unauthorized persons are banned from entering the area.
In a 12-page decision on the petition for injunction filed by the INC in September 2015, Quezon City RTC judge Edgar Dalmacio Santos of Branch 222 said the INC has, for purposes of this case, established by preponderance of evidence that it is the registered owner of the subject property.
In the decision, Judge Santos ruled that no person who is not authorized by the INC should be allowed to enter the property.
The judge partially granted the INCs petition for injunction which was filed two years ago against expelled INC members led by Felix Nathaniel Angel Manalo and Lolita Lottie Hemedez since it had been proven that they had earlier allowed hooded and armed men from entering the property based on photo and video footages submitted by the INC.
In its decision, Judge Santos enjoined the expelled Manalo siblings from allowing persons from entering and/or exiting the subject property through unauthorized means (i.e. not through the gates and without going through proper identification procedure).
The decision also barred them from allowing hooded men from entering/loitering the subject property. Thirdly, the court also specifically barred Angel Manalo and Lottie Hemedez from allowing armed unidentified men from entering/loitering the said INC property.
QC court notes entry of unidentified masked men in T. Sora property
The court found merit in the evidence presented by the INC that unidentified hooded and masked men were able to enter the 36 Tandang Sora property as early as September 2015, a few months after Angel Manalo and Lottie Hemedez were expelled by the INC for violating its doctrines.
The decision particularly pointed out the testimony of witnesses and CCTV video footages that showed that several unidentified men, many of whom wore hoods and masks, were freely entering the propertys gates carrying various boxes and baggage from September 1 to 26, 2015.
The court also pointed out the evidence provided by the INC that even on July 26, 2015, or just three days after Angel Manalo and Lottie Hemedez were expelled from the INC, several armed men were already seen inside the Tandang Sora compound which they were occupying. The armed men were seen together with the other defendants, expelled INC ministers Roel Rosal and Joy Yuson, who acted as leaders during their assembly.
The plaintiff (INC) avers that notwithstanding that the defendants Angel Manalo and Lottie M. Hemedez are mere occupants by tolerance of their houses, the latter abused the same by allowing unidentified persons to go in and out over its objections, the courts ruling noted.
Among those who were named as unauthorized persons to enter the property were expelled INC members Roel Rosal and his wife Shirley, Joy Yuson and several other persons.
It was only on September 1, 2015 that the INC installed CCTV cameras near the area to monitor the movement of persons illegally entering the property.
The court also later allowed the INC to post guards outside the gates of the 36 T. Sora property after evidence from the CCTV video showed how unidentified men had been freely entering the property without the INCs knowledge.
Faeldon and military-looking men also seen in T. Sora property
A month later, in October 2015, seven military looking individuals accompanied by the then lawyer of the expelled Manalo siblings, Atty. Trixie Angeles, were seen trying to enter the property. They were later identified as soldiers linked to former Army captain, now Bureau of Customs commissioner Nicanor Faeldon. In fact, Faeldon was also seen trying to enter the INC property, accompanied by his former lawyer in the Magdalo case, Atty. Angeles, and another lawyer, Ahmed Paglinawan.
The court noted that Atty. Angeles accompanied these seven military-looking men whom she was trying to get inside the Tandang Sora compound. She claimed they were hired as houseboys and gardeners by her clients.
These military-looking men were identified as John Santiago Jr., Cochi Briagas Ayad, Robert Tonogbanua, Florencio D. Acabo, Joseph Sabbaluca, Jonathan Ledesma and Virgilio Espejo. Almost all of them were later confirmed to be members of the Philippine Armed Forces and were allegedly connected to Faeldon.
Jonathan Ledesma and Jonathan Sabbaluca were among the 30 persons rounded up on March 2 by the police from the Tandang Sora property.
Ledesma, with Sabbaluca at his side, even shot and injured two police officers during the serving of a court-issued search warrant on the property on March 2. He had been charged with illegal possession of firearms, and direct assault with frustrated murder, for the shooting.
He and Sabbaluca had admitted that they were former members of the Philippine Marines and were involved in the Magdalo mutiny wherein Faeldon was one of the leaders.
Almost two years after the INC filed its petition, the Quezon City court said that the INC was able to prove that there is an urgent and permanent necessity to prevent serious damage to its property at no. 36 Tandang Sora Avenue in Quezon City, especially since unknown/unauthorized armed/hooded men (were) seen in the subjecty property being occupied by defendants Angel Manalo and Lolita Hemedez.
QC court rules INC has right to protect its property.
The court ruled that the presence before of unidentified armed and hooded men in the property was a substantial/material invasion of the plaintiffs right to know of the people going in and out of its property in relation to its right to protect itself and its property.
On March 2 and 8, the Quezon City Police District found a large cache of high-powered firearms and ammunition inside the 36 Tandang Sora property then occupied by the expelled Manalo siblings and their supporters.
The Quezon City Prosecutors Office has already recommended no bail for Angel Manalo after it found probable cause for the charges of illegal possession of firearms filed by the police against him on Friday, March 3.
More high-powered firearms and ammunition were, however, later found in the building occupied previously by expelled INC member Lottie Hemedez who is also facing similar charges.

Concerned authorities are currently conducting a probe on the possible link of Customs Commissioner Nicanor Faeldon to the several high-powered firearms and ammunitions seized inside the residence of Angel Manalo the dismissed Iglesia Ni Cristo (INC) member and brother of INC Executive Director Eduardo Manalo inside the disputed INC compound in Quezon City.
The investigation is being conducted after two former military men who were earlier arrested by the police inside the compound admitted that they were Faeldons men.
Among the pieces evidence of the police were the CCTV footage of men wearing bonnets and masked men entering the compound with big bags and boxes almost at the start of the stand-off and when security was not too tight.
CCTV footages revealed that masked men were seen bringing in suspicious looking baggage inside the compound at the time when security was still lax.
Several days after the baggage were brought in, the group of Faeldon who was not yet the Bureau of Customs (BOC) chief then went inside the compound.
The group included several retired and dismissed military personnel who were earlier involved in a failed coup de etat.
One of them was ex-Staff Sergeant Jonathan Ledesma who was positively identified in the CCTV footage while in the act of drawing his gun during one commotion in front of the gate of the compound.
The gun was suspected to be one of those placed in the baggage that was brought inside the compound by the masked men earlier caught in the CCTV footage.
Reports from social media also showed the picture of Manalo carrying a firearm with various high-caliber guns and ammunitions in the background.
Faeldon who is now abroad cannot be reached for comment.0 -

Thats how the police described the new cache of weapons they said they found at 36 Tandang Sora Avenue, Barangay New Era, which earlier yielded 5 guns and hundreds of rounds of ammunition when first raided last week.
The Quezon City Police District (QCPD) said another search conducted on Wednesday uncovered 56 rifles, 18 pistols, 27 hand grenades, and 62 rifle grenades. Also found were over 17,000 rounds of ammunition and gun spare parts.
The QCPD first raided the compound on March 2 after obtaining a search warrant and rounded up 32 occupants, including expelled INC members Angel Manalo and Lottie Manalo-Hemedez, the estranged siblings of Iglesia executive minister Eduardo Manalo.
Members of the QCPD Talipapa station were given permission by the INC leadership to conduct a clearing operation on Wednesday afternoon, this time focusing on a building adjacent to the house used by Angel Manalo, the Inquirer learned.
The QCPD said the search was conducted in the presence of INC officials, Barangay New Era officials, and staff members of an INC-owned media company.
The raided buildingwhich was not searched in the March 2 operationwas said to have been previously occupied by Hemedez. Sources said the structure looked abandoned and had no water or power supply when the police entered it, but that the guns found there were in good condition.
The QCPD director, Chief Supt. Guillermo Lorenzo Eleazar, said the newly found weapons were mostly high-powered and discovered in a secret room on the ground floor.
Presenting the guns to the media on Thursday, Director Oscar Albayalde, chief of the National Capital Region Police Office, said such a sea of firearms may be considered to be voluntarily surrendered by the INC leadership.
The leaders of the politically influential religious group sought the expulsion of the expelled Manalo siblings from the property after an internal dispute went public in July 2015. The siblings refused to move out even after the INC obtained a Manila court order for their eviction in July 2016.
We cannot blame the INC leadership because they did not have control in the area for a long time. We dont know where these weapons came from, Albayalde said. Even if we say INC owns the property, they are not staying there. How could they amass these firearms?
It will depend on who kept these weapons Liability will fall on the person who maintained (the armory), the official added.
