H1B Stamping in Manila

Hello Everyone!

Newbie here. Just wanted to ask if anyone here has a similar experience or knows anyone who's under the same circumstance. I'm currently working here in the U.S. I have an H1B visa. When I entered the U.S., I used my B1/B2 visa because I was really only here for vacation. But by some form of luck, someone offered me a job and sponsored an H1B visa. I was never out of status. I got my H1B before my I-94 expired. So here's my dilemma... I wanna go home in December to visit my family. Because I got my H1B here, I have to go to the US Embassy in Manila to get H1B stamping. Anyone here who has gone through this process? I wonder kung may nade-deny ba sa ganun or their visas put on hold, or madali lang ba?

Any feedback is very much appreciated. Thank you!

Your case is one of the reason why Filipinos are having a difficult time in applying for a tourist visa.

You might have successfully changed your status from your B1/B2 visa to working visa but the US embassy will be able to verify that you have violated the conditions of your stay.

Your best bet is to contact a lawyer for the best advice or apply for a PR and wait for its approval.

for H1B visa holders who went through "legal" process, 2 things can happen:
    1. no problems with the interview, so you will get your visa within a week.
    2. You'll receive a 221g form, dahil merong kailangang i-verify ang embassy about sa employer mo.

    Very rare ang nade-deny.

However sa case mo, most likely na makita yung hindi mo pag uwi noong B1/B2 holder ka pa lang, so malaking risk yan. Pero you can always try to explain kung anong nangyari, i think pasok ka pa din naman sa "legal" process eh since hindi ka naman nag tnt/out-of-status. but again, risky.

I had my interview for h1b renewal 3weeks ago. The CO approved my visa stamp and didnt ask for any additional documents. Na-mention lang nya na hindi pa daw updated sa system nila yung petition ko but it happens naman daw. Sabi pa nya I should be fine. May nag-reply na "as amended", my case will be under Admin Processing and they cannot provide a timeline as how long the process will be. :(
