hi meron po bang guide or guidelines kapag nagkaroon ng vehicle accident besides the usual police report?
if may thread na po dati regarding dito I apologize in advance di ko kasi mahanap. Napansin ko kasi pag naaccident mga friends ko parang clueless sa process so ayoko mangyari sakin yun.

kung may insurance ka .. requirement ang police report para mag claim .. pero pag wala at minor lang ang damage puwede ng areglo iyan ...
magbabayad ka pa sa pulis sa pag claim ng accident report ...

Take a photo of the accident if you have a camera. Get photos of both vehicles or whatever got involved in the accident.

A police report is required to make an insurance claim but as was already mentioned, if the damage is minor, then it might be better for you to just come to an arrangement with the other party.

If the damage is severe, a witness report from both parties including sketches would be required by the police. The police would then determine who is at fault.

A popular way of getting insurance claims these days is to have a camera on your dash. A lot of insurance claims have been made by supplying the video after an accident to prove that the driver with the camera is not at fault. Cameras such as the ones from gopro have attachments that allow you to install it on your dashboard.

Get a police report! Huwag kang maniwala sa bumangga sa iyo na may kilala syang talyer na ayusin sasakyan nyo. Malaki chances tatakasan ka nalang nyan eventually, style ngayon nyan nowadays especially mga naka delivery van na PASAWAY o PASAWAY na motorsiklo.
Pag walang police report walang patibay kung sinong may sala or worse na merun aksidente.

Yung unang aksidente na nakasangkutan ko na ako ang driver, year 2010, from Tanay, paakyat na ako ng antipolo from hospital duty, merong tricycle, came out of nowhere, bumangga siya sa sides nung harapan ng sasakyan ko, nag take over siya, pero nabangga ako.

First time ko so nakatulala lang ako, kasi tumaob yung tricycle, so hindi ko na naiisip kung ako ang nasa mali or yung isang party, basta pagbaba ko, I was asking for sorry agad, kasi sila ang nasaktan, ako naman, okay naman ako.

Okay naman yung tricycle driver, yung dalawang pasahero lang niya ang nasaktan, pero wala naman sugat, nabunggo lang yung sides, so sinugod muna namin sa ospital, eh dahil naka pang nurse outfit ako nun, ako ang kasama mag sugod sa ospital, hindi ko siyempre pwedeng iwanan sa gitna ng kalsada yung sasakyan ko, so tinabi ko muna, bago bumaba ako ulit para nga isugod yung pasahero.

Ah yun na, that reaction from me, gave the tricycle driver some confidence na ako ang singilin sa damages ng tricycle niya, so after namin mahimasmasan, I asked the two passengers kung nakita ba nila yung pangyayari, and sabi nila, yung tricycle driver daw kasi eh napakabilis ng takbo.

Pagbalik ko dun sa site, nagtapang tapangan na yung tric drivers, may mga witness pa kuno na ako daw may kasalanan kaya bayaran ko daw tric niya. I called up my husband na puntahan ako dun sa site (1 hour away from our house), and pagdating ng husband ko, after kausapin din yung witnesses, sinabi ng husband ko sa tric driver "punta tayo sa pulis, yung mismong pasahero mo sinasabi na ikaw ang may kasalanan, ngayon, pag napatunayan na ikaw may kasalanan, bayaran mo lahat ng sira sa sasakyan namin".

Pero iniinsist nung tric driver, na tinabi ko daw kasi yung sasakyan kaya hindi na makikita kung sino ang may kasalanan, (tinabi din niya tric niya), tapos yung mga taga dun sa Tanay (taga tanay yung driver, ako dayo lang) kinakampihan nila yung driver, na nakita daw nila ako may kasalanan. Wala naman pulis na dumadating, so niyayaya sila ng husband ko sa pulis, ayaw naman sumama.

Tapos, nagkakataasan na ng boses, yung tric driver, ayaw ng pumunta sa pulis, tapos sumakay na siya sa tric niya, then umalis, hinahabol ng husband ko, pero pinigilan ko na lang kasi baka pagtulungan kami dun sa lugar na hindi kami pamilyar.


From my story, ano ang mga key points na maikokomento ninyo? Ayaw ko naman maaksidente ulit, pero sa experience ko na yun, isang taon akong hindi naka pag drive.

- paano ba ang set up? Kailangan naka harang ang sasakyan na naaksidente, hanggat walang pulis? Hindi ko naman naisip kuhanan ng pic, dahil natulala nga ako.

- paano kung yung bumunggo sa inyo, eh siya pa ang matapang at galit galitan, at nagkakaroon pa ng trouble?


Halos 10,000 din nagastos namin para sa repair nung sasakyan, but the trauma for me, ay naku, 1 taon kong dinala. Nag da drive na ako ngayon, medyo may nerbiyos pa din.

That is the problem with no police report. I know how you feel, and it is hard to just leave your vehicle in the middle of the road, antipolo pa!
People nowadays would lie for their own convenience, wala ng honor nowadays.

Moral of the story..
1. Yes, try to take a photo of the vehicles involved with plate nos.
2. Kapag tricycle or Jeepney nakabangga mo, more often than not wala ka makukuha sa kanila regardless kung kasalanan nila or hindi. I don't want to sound mayabang or anything pero ano ba naman pangbabayad nila? Kaya nga sila namamasada. So kahit saan mo tignan, talo ka. And that is the sad reality.

Azulbanirpal , nakakatakot maaksidente sa isang lugar na liblib, tapos taga dun pa mismo yung other party, basta sila ang alam lang nila kampihan yung taga kanilang lugar.

MajorPain, noted. Ang nakakainis pa sa mga jeepney at tric drivers, akala mo siga siga sa daan, pag naka bunggo naman, sorry na lang. Sabagay, magasgas o mapipi yung parte ng sasakyan nila, no big deal naman.

Jazzmine, it's good that your husband was not so far away. I don't like to stereotype but tricycle, pedicab and jeepney drivers tend to bully women drivers. They also never have any money to pay for damages. When something happens, get the license plate immediately. Try to get a photo if you can.

Other cases my friends and I have experienced would be bicycles and motorcycles that side swipe you in traffic and run away. At least you can go to the traffic police later and report the license and it will be logged as a hit and run.

If there is a police report and eventually the errant driver refuses to pay damages or hides from you, isn't there something that the police or LTO can do like they have a hit and run record with police or their license is revoked by the LTO?

If the errant driver waited for the arrival of the police then he can't be charged with hit and run. What you can do is file a criminal case for reckless imprudence resulting in damage to property. The police report should include the address of the driver so the prosecutor will know where to send the summons.

Based from my experience whether it is an accident with a PUV or a private vehicle you should:
1. Never move the vehicle and touch anything (ex. disengaging the signal light, etc.) after the accident as much as possible.
2. Immediately call for a backup if you're alone.
3. Take a photo of the other vehicle's plate no. and the situation of the accident.
4. Never give or show your driving license to the other party, only the police can look for it.
5. Always call and wait for proper authority so that they could make a police report, even if it is your fault.

Note:
Usually other people (even if it is their fault) will raise their voice to startle you so that you will be submissive, keep calm and ignore it until the police arrives.

Thanks Azr1992, Nietono for the posts, dapat talaga merun police report for obvious reasons.
Again style na talaga ng karamihan ng tao nowadays, kasalanan nila dadaanin sa pilosopo reasoning, blame you for it, or bully you. Merun din dyan pag nakawala na magiiba ng cell phone and parating wala sa bahay kahit habulin mo.

Wish i had read this thread earlier.. i just got hit by a motorcycle kanina and wala akong idea kung ano gagawin ko.. sa sobrang panic ko tinabi ko kagad sasakyan ko dahil nagdudulot ng traffic from both lanes and never bothered taking a pic of the scene.. buti na lang may witnesses at walang masamang nangyari sa nakabangga sakin.. pero nakakadamage ng confidence sa pagdadrive kahit di ko pa kasalanan..

Anyway just want to say very informative thread.. at least alam ko na gagawin ko next time.. pero naman hopefully wala ng next time
