QUEZON CITY, METRO MANILA — Marikina City Representative Marcelino Teodoro has proposed banning parking fees in malls, hotels and other public commercial areas.

Teodoro criticized the excessive collection of fees by establishments that take advantage of parking space for commercial use.

He admits parking space contributes to the “economic viability” of local businesses. However, he points out that more and more establishments are profiting from it, charging extra after three hours.

“The fact that the commercial centers and shopping mall managements always deny responsibility for the loss of any vehicle or any personal property left inside the car, even if it occurred inside their guarded parking areas, is a glaring example of customers being short-changed,” Teodoro said in an advisory.

Under the measure proposed by Teodoro, owners of shopping malls, hotels and similar business and commercial establishments are prohibited from “imposing, exacting, collecting or charging any fees for the use of parking spaces located within these establishments.”

The measure also states that no building permit shall be issued for the construction of business and commercial establishments that include parking spaces and facilities, buildings and other facilities for parking purposes unless the owner submits an affidavit that parking spaces and facilities shall be made available to their patrons or customers free of charge.

The bill also provides a penalty of imprisonment of not more than five years and a fine of not more than P500,000 to violators.

Instead of profiting from the use of parking spaces, Teodoro suggests commercial establishments should give back to their loyal customers.

    This is pretty old news and my stance has not changed. Teodoro appealing to the populist sentiment without thinking it through.

    The reason why establishments charge extra for over 3 hours is to avoid people like office workers who will park the whole day and not necessarily spend at the mall.

    Perhaps a compromise would be requiring malls to give out free parking vouchers for people who spend XXX amount at the mall, much like how it works with hotels.

    In any case, what's so wrong about establishments profiting from parking? Companies invest in the land and the parking building so why shouldn't they be allowed to profit from it.

    ok lang naman siguro parking fee pero minimal lang dapat, hindi naman justified yung high charges

    Totally agree with this. And the suggested alternative (to no cost parking) is good, though I'm sure the habitual window-shoppers would disagree...

  • fair compromise dapat. since we're paying, we should have assurance of the safety of our cars. wala dapat yung MGA one sided disclaimers na naka fine print sa likod ng parking tickets.

    i do not agree to ban the parking fees. just simply wouldn't work.

    Un sa mga office buildings kaya... sana me cap. Grabe taas ng parking fee. Mas mahal pa minsan parking ko sa food ko for that day :mecry:
  • Grabe nga eh, mag grogrocery ka sa Hypermart, gastos ka ng 2K, tapos babayaran mo pa yung parking mo sa kanila. Ok na siguro yung pagvalidate ng resibo dun sa isang establishment sa mall.

    Pinapalagaan lang ng mga parking owners laban sa mga MANDURUGAS na mag-claim na may nawala sa kanila samantalang hindi naman pinasok ang sasakyan nila. Sa 'Pinas pa naman na puro CORRUPT ang mga tao.... :glee:

  • isang litrong gaso din yang parking fee na yan, okay lang sa kin, nabawasan na pagpunta ko sa mall, at least maka-save man lang ng pera, dati at least 2 times per week nasa mall ako, ngayun siguro almost a month na since my last visit to those fuc'kin malls.

    bad trip nga last punta ko sa mall , nagbayad na ng parking fee, tapos kong mag grocery siningil pa ko me bayad daw plastic bag sa grocery ampvtah na yan!

    MANILA, Philippines - Mall owners can collect parking fees from motorists using their premises without violating the law, the Supreme Court (SC) has ruled.

    In upholding the Court of Appeals and Makati Regional Trial Court, the SC said the National Building Code and its implementing rules and regulations do not require mall owners to provide free parking spaces for shoppers.

    “In conclusion, the total prohibition against the collection by respondents (Ayala Land Inc., Robinson’s Land Corp., Shangri-La Plaza Corp., and SM Prime Holdings Inc.) of parking fees from persons who use the mall parking facilities has no basis in the National Building Code or its IRR,” read the SC decision.

    The SC said the state would be acting beyond the bounds of police power if allowed to stop mall owners from collecting parking fees.

    “The state also cannot impose the same prohibition by generally invoking police power, since said prohibition amounts to a taking of respondents’ property without payment of just compensation,” read the SC decision.

    “Without using the term outright, the OSG is actually invoking police power to justify the regulation by the state, through the DPWH secretary and local building officials, of privately owned parking facilities, including the collection by the owners/operators of such facilities of parking fees from the public for the use thereof.”

    The SC rejected the government’s argument that free parking spaces in malls would help ease vehicular traffic.

    “Free parking spaces at the malls may even have the opposite effect from what the OSG envisioned,” he said.

    The SC said despite being charged parking fees, motorists continue to use the parking facilities of malls.

    “Vehicle owners may be parking in the streets only because there are not enough parking spaces in the malls, and not because they are deterred by the parking fees charged by respondents,” read the SC decision.

    Promulgated last Sept.18, the SC decision was written by Justice Minita Chico-Nazario.

    Totoo lang agree ako sayo

    Sa Philippine National Building Code required ang mga establismento na magprovide in proportion ng parking space para sa mga customers nito.

    Yun Quezon City nagpatupad ng ordinance na bawal maningil ang mga establishmento ng parking fee kung sa sidewalk naka-park ang sasakyan. Yun Makati naman kabaliktaran.

  • You don't want to pay then don't park there. Don't patronize businesses that charge for parking if it's really that big of a deal. Government didn't build those parking lots and garages so they shouldn't have any say in it.

    we are just exercising our right's to agree or disagree in this democratic piece, so what the F is wrong with some pexters here, if no one's exercise their right's to disagree, for Christ sakes i would imagine the gas price would have been reached 60, 70, 80 pesos per liters now. :love::rpflag: peace *okay*
