employer willing to petition me

HI! just would like to know your opinions.. my auntie( employer) is willing to petition me here in US to work for her. I'm currently now in the US. everything happened so fast. sabi nya pwede na ako d umuwi para ma file na yung petition ko. ang dilemma ko is i'm not ready. yes, kasama ko family ko my husband and kid pero may problem pa kami naiwan sa manila. i'm thinking kung uuwi muna kami ayusin ang problem then go back here. or i'll stay and sila ang uuwi. pero sila matagal na bago bumalik. parang d ko kasi makakayanan ang lungkot eh. help naman. thanks!

  • mas maganda wag ka muna umuwi kasi mas mabilis ang change of status compared kung uuwi ka pa & magpastamp ka pa sa pinas, risky yun, one of the questions ng vo dun is how did you meet your employer, since tourist ka pa dyan makikita nila na nakipagmeet ka sa employer mo habang andyan ka as tourist status & by there it's a 50-50. pati sa point of entry tinanong din sakin yan. mas maganda kung pati family mo kasama sa change of status. mahirap kapag papasunurin mo pa sila. ako nahihirapan kasi nasa pinas pa sila

    From a petition standpoint, I'd say it's better if you stay in the US, less risk and hassle, less chances of you dealing with immigration officers and facing questions. From a human standpoint, I'd say follow your heart :) Sounds cliched, pero talagang mahirap sa ibang bansa lalo na kung malungkot ka at hinahanap ang pamilya mo. Hindi mo rin mae-enjoy ang bago mong buhay kung wala ka pang closure sa Pinas. Imagine working tapos homesick ka pa at lagi mo pang iniisip yung mga hindi mo pa natapos sa Pilipinas. Buti sana kung madali lang yung process ng petition at makakauwi ka ng agad-agaran.

    Pero whether you choose to stay or go, I advice to keep your family with you po. :) Mas mahirap nga kung papasunurin mo pa sila, dun pa sila mag aayos ng mga documents sa Manila. Kung sa US sila kasabay mo mas madali na lang.

    well, we decided na umuwi muna ng pinas at ayusin ang ayusin. para may closure din ako bago talaga mag stay dito. babalik nalang kami after 6 months or so. at least pag nag umpisa dito tapos na lahat ng problema sa pinas at wala ng iintindihin pa. thanks sa lahat ng opinion nyo. kung dito naman talaga kami WILL ni GOD na papauntahin ulit kami dito. Thanks again sa lahat. :)

    kahit naman magchange status siya sa US kailangan pa rin niyang magpastamp ng visa sa pinas unless wala siyang balak umuwi for the whole duration of his H visa which is 3 years then another 3 years extension..

    application for h1b always starts on april.. pero you can only start working by oct 1st..

    ke june/july/sept/ ka magapply at maapprove.. oct ka pa rin magstart magwork hanggat di pa ubos yung quota this year..

    your employer will most likely need a lawyer.. pero kung kaya nila magfill up ng mga forms, your employer can do it..

    in my case yata nun if i remember it right after 3 months approve na ng USCIS.. then ipapadala sayo ng employer mo yung (notice of action) approval along with supporting documents para magpaschedule ka ng appointment sa US embassy for visa stamping..

    yes, once isubmit ng employer application mo for h1b sa uscis, he will get reciept number.. you can ask that from him para ma-track mo status ng h1b mo online sa uscis website.. it will tell you kung approve/deny or may additional documents required..
  • ano ba setup nyo? yung iba employer na maghahanap ng employer. yung ibang petitioner naman, kailangan ikaw pa maghire ng lawyer.

    well, may nakausap na kaming lawyer. sad to say sabi ng lawyer ako daw malabo ma petition ng auntie ko kasi di naman special skill yung course ko (bussiness management graduate) unlike my husband who is a graduate of aeronautical eng. mas may potential daw sya. and sabi ng lawyer if he is going to apply a H1B visa kelangan nasa manila sya para less problem. once na makakuha sya ng employer i-fi file agad ng lawyer yun. and dapat within this year maka hanap pa sya kasi konti pa lang daw yung quota.

    so pag uwi namin tsaka aayusin lahat and hopefully maayos at makakuha kami ng working visa. :)

    what's h2b naman? wala na kami ibang kakilalang lawyer eh.
  • h2b is a seasonal employment, 1 year lang talaga yun. yung sa hubby mo i don't think na madaling maghanap ng work kasi hindi naman ganon ka indemand yung aeronautical eng, indemand ngayon pt, yung nurses hindi na masyado kasi madami na graduates dito. manghingi ka ng referral ng ibang lawyer siguro sa auntie mo kung matagal na siya dito. from my experience mas maganda kung us based ang lawyer mo. may napuntahan ako dyan sa ortigas hindi naman helpful hindi naman ako natulungan mahal pa ng fee.

    US Lawyer yung kausap namin. and we're here in US ngayon. pero uwi na din kami sa 17. yun lang din ang lawyer nya i think..
