“KAILANGAN namin ng tulong kaya kami lumapit sa kanila pero ginawa nila kaming busabos.” Thus cried Nenita Mendoza, a mother from Bgy. Upper Bicutan who was denied assistance at the Philippine General Hospital after presenting a certificate of endorsement from Senator Alan Peter Cayetano.

Mrs. Mendoza was suffering from a lingering heart condition when the senator’s staff member Peter visited her at her home last March 5.

After learning her condition, Peter asked for Mendoza’s prescription and gave her three certificates – two P3,000 vouchers and a P3,000 voucher at the Philippine Heart Center.

But when Mendoza proceeded to PGH expecting to avail herself of medical assistance, the hospital did not honor the lawmaker’s certificate. She also went to the Philippine Heart Center (PHC), but only got 10 pieces or P240 worth of medicines.

“Huwag na daw akong bumalik dahil wala na akong makukuhang gamot sa kanila,” said Mendoza when she called the PHC, despite having a voucher valid until May 11.

Mendoza is just one of the many residents who have received the “bouncing” vouchers from Sen. Cayetano and his wife, Taguig First District Rep. Lani Cayetano.

Francis Paul Latosa of Bgy. Western Bicutan, on the other hand, was issued vouchers -- P2,000 at PGH from Sen. Cayetano, and a P1,500 at the Department of Social Welfare and Development (DSWD) from Rep. Cayetano dated March 18.

He was hoping to seek medical assistance for his twins -- Jacob and Jarred -- who were both born prematurely at eight months last February 21, with the Jarred suffering from meningitis.

Latosa even had to borrow money for transport fare, only to be denied medical services upon reaching PGH.

He also tried to claim the P1,500 voucher from DSWD to be charged under Rep. Cayetano’s trust fund, but to no avail.

Last March 25, Latosa followed up the vouchers with Cayetano’s office in Bgy. Bagumbayan.

He was able to talk to a certain Ms. Jo from the district office, who advised him to borrow money since the funds were not yet available at that time.

“Wala pang pondo sa ngayon, sa April 10 baka meron na, kaya manghiram ka na lang muna sa kakilala mo,” Ms. Jo advised Latosa.

Fe Guinto, whose home was razed by fire last month, was also issued a voucher worth P4,000 by Rep. Cayetano dated March 16 for redemption at the DSWD-National Capital Region.

She has had no success in tryihg to redeem the voucher several times at the DSWD-NCR.

Ronnie Sayas, a Bgy. Upper Bicutan resident and suffering from an infected wound, was issued two P1,000 vouchers by Sen. Cayetano at the National Kidney Institute. The wounded boy, despite numerous calls to the hospital, failed to get medical assistance.

They are among the many residents who have suffered the same fate with the “bouncing” vouchers of the Cayetano couple.

Records from the House of the Representatives show that from years 2007 to 2010, a total of P56.5 million has been earmarked as trust fund of Lani Cayetano for the following institutions: PGH – P3M; Philippine Heart Center – P2.75M; Rizal Medical Center – P5M; Nat’l Kidney Institute – P6.2M; Philippine Orthopedic – P1M; and DSWD – P36.5M.

The lady solon even gave trust fund amounting to P2 million to the Ospital ng Makati, but has not extended any support to the Taguig City Hospital.

    Husband and wife bid for House seats completely legal, says Alan Cayetano


    There is nothing illegal and immoral with a married couple running together for seats in the House of Representatives.

    “It’s not unique, and it’s completely legal and moral,” resigned Foreign Affairs Secretary Alan Peter Cayetano told INQUIRER.net on Wednesday.

    Cayetano said this when asked about his and wife’s, incumbent Taguig Mayor Lani Cayetano, decision to run as representatives of First and Second Districts of Taguig, respectively, in the upcoming elections.

    Their case, he said, was not unique as he cited the case of Isabela Rep. Rodolfo Albano and latter’s wife, Deputy Speaker Mylene Garcia-Albano, who he said is the representative of Davao.

    “Magkasama sila sa Congress ngayon,” he pointed out.

    Alan Cayetano also explained that he lives in their ancestral home in District 1 while his wife has a residence in District 2.

    “So as long naka-one year ka dun sa lugar mo and may intent ka to live there, pupwede yun,” he explained.

    As mayor of Taguig, he said his wife knows the problems and solutions of the city.

    He said he also feels that it would be better if he and his wife will work together in Congress.

    Aside from his wife, Alan Cayetano’s siblings will also join the 2019 elections.

    His sister, Taguig Rep. Pia Cayetano, will seek a comeback in the Senate while their brother, Lino Cayetano, will run for mayor of Taguig City.

    Friends no more? PDP-Nacionalista alliance in peril after ruling party endorses Cayetano’s rival in Taguig-Pateros


    It looks like the alliance between the Partido Demokratiko Pilipino – Lakas ng Bayan (PDP Laban) and Nacionalista Party (NP) is officially over after the ruling administration party has decided to support another congressional candidate in the legislative district of Taguig-Pateros.

    Multiple sources told Politiko that the camp of former Foreign Affairs Sec. Alan Peter Cayetano was disappointed with several top honchos of PDP Laban upon learning that it has endorsed Allan Cerafica as district legislator of Taguig-Pateros in next year’s midterm elections.

    Cerafica is the brother incumbent Taguig-Pateros Rep. Arnel Cerafica.

    The incumbent Taguig-Pateros solon, who was also able to secure an official nomination from PDP, meanwhile will be battling Cayetano’s brother, television/film director and former Rep. Lino Cayetano in Taguig City’s mayoralty race.

    According to the same source, Cayetano felt betrayed over the recent antics instigated by some officials of the ruling party since PDP and NP have an existing alliance since 2016.

    Cayetano, a stalwart of NP and one of President Rodrigo Duterte’s main allies, is eyeing a return in the House of Representatives in the upcoming midterm elections.

    The former chief diplomat earlier admitted that his supposed House comeback was connected with his plan to win the Speakership in the next Congress.

    Meanwhile, two separate sources in the Lower House revealed that Duterte has nothing to do with the decision of his political party to support the rivals of the Cayetanos in Taguig City and the point person who gave the certificate of nomination and acceptance (CONA) to the Ceraficas is an official of PDP identified with Sen. Aquilino “Koko” Pimentel III.

    One source told Politiko that it was Engr. Salvador “Toto” Ty, PDP Laban vice president for National Capital Region (NCR), who issued the respective CONAs to the Cerafica siblings upon the instruction of Pimentel’s deputy chief-of-staff, Ronwald Munsayac.

    Munsayac is also the current chair of the PDP Laban Public Information Committee.

    Cancellation of Cayetano couple’s Taguig congressional bids sought

    (UPDATED) The different addresses the former foreign affairs secretary and his outgoing mayor wife declared in their respective certificates of candidacy present 'legal infirmities,' the complaints say

    MANILA, Philippines (UPDATED) – Two separate petitions have been filed with the Commission on Elections (Comelec) to stop the congressional bids of spouses Alan Peter Cayetano and Lani Cayetano, who are running in different districts of Taguig in 2019.

    Election lawyer Emilio Marañon III, representing Taguig voter Leonides Buac Jr, said the different addresses that the former foreign affairs secretary and his outgoing mayor wife used in their respective certificates of candidacy (COC) presented “legal infirmities.”

    To run in the first district of Taguig, the former senator declared in his COC that he is a resident of Barangay Bagumbayan. Lani, who is running in the second district, declared that she resides in Barangay Fort Bonifacio.

    Why is having separate addresses anomalous?

    In separate complaints against Alan Peter and Lani filed on Monday, November 12, Marañon said Articles 68 and 69 of the Family Code mandate a couple to live together in one matrimonial domicile or residence.

    “As a consequence of this obligation to live together, the chosen abode of the husband and wife is deemed to be their domicile or legal residence for all legal intents and purposes…. Thus, one spouse cannot keep his or her own domicile, separate and independent from the matrimonial domicile,” the complaints read.

    “For this reason, the matrimonial domicile is controlling in determining the residence of the spouse who is seeking to run in an election.”

    “Thus, Alan cannot claim domicile in Barangay Bagumbayan, while his wife, Lani Cayetano, in Barangay Fort Bonifacio. In other words, they cannot run in two different districts or jurisdictions at the same time,” Marañon, a Rappler columnist, said in a complaint brief.

    Yet, the Cayetano couple, “despite being married and obliged by law to live together in one domicile…ran in TWO separate districts, thereby raising serious legal infirmities as to their qualifications,” the complaints pointed out.

    What are the Cayetanos’ alleged liabilities? Since the complaints will force the couple to choose which is their domicile, one of them will turn out to have declared a false address.

    If the more recent address is identified as the domicile, then the one using it has the burden to prove he or she has established residence there in time for the elections.

    Article VI, Section 6 of the 1987 Constitution requires that a congressman or congresswoman is a resident of his or her district "not less than one year immediately preceding the day of the election."

    Either way, the Cayetanos can be held liable for having declared false information, which will merit the cancellation of their COCs.

    What is the petitioner asking the Comelec to do?

    The prayer is for the Comelec to deny the Cayetanos due course and cancel their COCs.

    If Comelec grants this, then the names of Alan and Lani will not be included in the list of candidates that the poll body is finalizing as of this posting. Their names will also not appear on the ballots for the 2019 elections.

    What has the Supreme Court said about similar cases?

    The complaints cited Supreme Court (SC) decisions establishing this principle.

    In Larrazabal vs Comelec in 1991, the poll body cancelled the COC of Adelina Larrazabal, who was running for governor of Leyte. She had declared her residence in Kananga town, but the Comelec cited her marriage to a resident of Ormoc City, where voters don’t vote for provincial posts.

    The SC upheld the Comelec, saying: “For the purpose of running for public office, the residence requirement should be read as legal residence or domicile…. Husband and wife as a matter of principle live together in one legal residence which is their usual place of abode.”

    In Marcos vs Comelec in 1995, the SC explained that “residence is synonymous with domicile.”

    Domicile, meanwhile, is defined in the New Civil Code as “the place of [natural persons’] habitual residence.”

    The Court recognized that Imelda Marcos, a resident of Leyte, “gained a new ‘domicile’ after her marriage” to Ferdinand Marcos of Ilocos Norte.

    She “only acquired a right to choose a new [domicile] after her husband died.”

    Who lives in Two Serendra?

    The petitioner cited the address declared by Lani Cayetano to also point out how the Cayetano siblings are establishing not just a political dynasty but “a super dynasty” in Taguig.

    Lani’s address in her COC is Unit 352-A, Two Serendra, Fort Bonifacio, Taguig City. It is also the residence declared by her in-laws – Alan’s siblings – in their own COCs in several elections.

    Alan’s sister Pia, the current representative of Taguig’s 2nd district (whom Lani is seeking to replace), is running for senator. The unit was her address in the 2016 and 2019 COCs.

    Alan’s brother, Lino (who served as 2nd district congressman before Pia did), is running for Taguig mayor to replace Lani. Unit 352-A was also his address in his 2013 COC.

    “If that condominium unit is the legitimate domicile of the three (3) of them, how can three (3) families HABITUALLY RESIDE and MAINTAIN LIFE together in such a tiny space?” the petitions asked.

    Marañon said the cases against the Cayetanos should be an opportunity for the Comelec to also “address this scheme of dynastic expansion…duly guided by the Constitutional policy against political dynasties and [Comelec’s] mandate to ensure greater access to opportuities for public service.”

    MANILA, Philippines – The Taguig City residence claimed by former foreign secretary Alan Peter Cayetano and his wife, Lani, isn't theirs, said the petitioner in the case to cancel their certificates of candidacy (COCs).

    Petitioner Leonides Buac Jr, through his lawyer Emil Marañon III, presented as evidence Condominium Certificate of Title (CCT) Number 10558 issued by the Taguig City Registry of Deeds. It covers Unit 352-A Two Serendra, Fort Bonifacio, Taguig City. This is the residence claimed by Lani Cayetano in her COC.

    Alan Peter is running as congressman of the First District of Taguig while Lani is running for congresswoman of Taguig's Second District. They face separate petitions before the Commission on Elections (Comelec) to stop them from running, based on the alleged misrepresentation about their residence since Alan registered a different address in his COC.     The Cayetano couple said they both reside in Unit 352-A, but Alan Peter's intention to stay remained in Bagumbayan. For elections, intention to stay is what is required in counting the number of years of residence, said Cayetano lawyer George Garcia.

    'Strange, conflicting claims'

    "The CCT showed that Lino Cayetano from January 31, 2007, to the present owns Unit 352-A, and not the spouses Cayetano," Marañon explained.

    "Considering their wealth, power, and stature, the fact that the spouses Cayetano do not own (or at the very least lease) their supposedly 'permanent' residence is evidence against their claim of permanence or legitimate 'intent to permanently settle' in Unit 352-A," he added.

    Buac's camp said this "game-changing and incriminating" evidence showed that Cayetano's brother, Lino, and not the Cayetano couple, owns Unit 352-A.

    Buac's lawyer detailed this new evidence in a press release Friday, December 21. This was after Buac's camp submitted memoranda on Thursday, December 20, "arguing that Lani and Alan Peter Cayetano are not residents of the legislative districts where they intend to run."

    Buac's camp said the CCT also supposedly showed that Unit 352-A is a single-bedroom unit, "which strengthens our previous position that the unit is a 'domicile of convenience' of the Cayetano family, conveniently claimed by Lani just to enable her to run in the Second District despite not living there."

    Marañon noted that the Cayetano couple "jointly claimed in their Answers that Unit 352-A is their 'family home,' but strangely Pia Cayetano in her sworn 2019 Certificate of Candidacy filed last October 16, 2018, she also claimed the single-bedroom unit as her own family home."

    "There is also no showing that the real owner, Lino Cayetano, has leased or sold Unit 352-A to his siblings or to anyone, thus he is still presumed to be in possession of the same. These strange and conflicting claims show the collective lies of the siblings, albeit poorly planned, again in furtherance of the Cayetano super dynasty!" said Marañon.

    The lawyer also cited Cayetano's admission that "he physically abandoned his former 'domicile of choice' in 209 Paso St, Barangay Bagumbayan in the First District and moved to Unit 352-A Two Serendra, Barangay Fort Bonifacio in the Second District." Cayetano reportedly "also admitted that with his wife, they constituted that same property owned by Lino Cayetano as their 'new' family home."

    "Alan's convenient defense is that despite moving as a couple to Two Serendra, Barangay Fort Bonifacio, his 'intent to settle' remained in Barangay Bagumbayan, their previous family home. He made this claim while at the same time claiming that her wife Lani's transfer constituted as change of domicile to Fort Bonifacio, but conveniently not in his case," Marañon said.

    "In other words, the rule that he applied to Lani strangely and most abnormally he did not apply to himself," he added.

    "Now, analysis of all the submissions would unequivocally show that the couple do not live in the Second District, and by their admissions, they also do not live in the First District. This raises one very curious question – where do they really live? Do they still even live in Taguig City?" Marañon asked.

    Cayetano's defense

    In a text message to Rappler, Cayetano's lawyer Garcia said Unit 352-A is Alan Peter's property.

    "There was a sale between him and Lino," Garcia said. He pointed out the sale is reflected in the Statement of Assets, Liabilities, and Net Worth filed by Alan Peter after he resigned from the Department of Foreign Affairs.

    "Moreover, one need not own the property before he can establish a domicile," Garcia said.

    Marañon noted that the Cayetano couple "jointly claimed in their Answers that Unit 352-A is their 'family home,' but strangely Pia Cayetano in her sworn 2019 Certificate of Candidacy filed last October 16, 2018, she also claimed the single-bedroom unit as her own family home."

    "There is also no showing that the real owner, Lino Cayetano, has leased or sold Unit 352-A to his siblings or to anyone, thus he is still presumed to be in possession of the same. These strange and conflicting claims show the collective lies of the siblings, albeit poorly planned, again in furtherance of the Cayetano super dynasty!" said Marañon.

    The lawyer also cited Cayetano's admission that "he physically abandoned his former 'domicile of choice' in 209 Paso St, Barangay Bagumbayan in the First District and moved to Unit 352-A Two Serendra, Barangay Fort Bonifacio in the Second District." Cayetano reportedly "also admitted that with his wife, they constituted that same property owned by Lino Cayetano as their 'new' family home."

    "Alan's convenient defense is that despite moving as a couple to Two Serendra, Barangay Fort Bonifacio, his 'intent to settle' remained in Barangay Bagumbayan, their previous family home. He made this claim while at the same time claiming that her wife Lani's transfer constituted as change of domicile to Fort Bonifacio, but conveniently not in his case," Marañon said.

    "In other words, the rule that he applied to Lani strangely and most abnormally he did not apply to himself," he added.

    "Now, analysis of all the submissions would unequivocally show that the couple do not live in the Second District, and by their admissions, they also do not live in the First District. This raises one very curious question – where do they really live? Do they still even live in Taguig City?" Marañon asked.

    Cayetano's defense

    In a text message to Rappler, Cayetano's lawyer Garcia said Unit 352-A is Alan Peter's property.

    "There was a sale between him and Lino," Garcia said. He pointed out the sale is reflected in the Statement of Assets, Liabilities, and Net Worth filed by Alan Peter after he resigned from the Department of Foreign Affairs.

    "Moreover, one need not own the property before he can establish a domicile," Garcia said.
