FilShams Amnesty? The PBA will loose its Credibility!!!

ThanThan PExer
Imagine this, a king, a president breaking his own rules just to gain more followings? Does credibility takes a backseat? That's what the commisioners office of the PBA will look like if it is true that they are looking to bend down on their previous ruling to suspend these Fil-fors who failed to prove their Citizenship under the Philippine Constitution. How about the insinuations or intrigues that will come out that teams like Ginebra & Smb (2 previous champion teams not really affected by the suspension of Filshams) will not achieve what they have gained if not for the ruling that affects teams like TNT, RedBull, Coke & Shell? It will be unfair to both teams that their hardwork will be tainted with issues & intrigues. My stand is, under the constitution, if you are eligible to play because your Filipino lineage was proven, then so be it. Otherwise lets not make obvious ways just to benefit others. Credibility is very important to any Leader & Institution!

First of all it is not PBA Commissioner Noli Eala who proposed the amnesty. It is PBA Governor Ely Capacio. So the King (Eala) is not bending the rules.

Second, the amnesty (according to Eala's guidelines) will only apply to certain Fil-Foreigners and the main requirement for a player to be given amnesty is that he should have played for the national team.

Thus, players like Devon Harp, Rob Parker, Sonny Alvarado, etc are not beneficiaries of this amnesty. The beneficiaries are only Eric Menk, Rudy Hatfield and possibly Mick Pennisi only.

In the case of Menk and Hatfield, there is no doubt that they have Filipino blood. But due to a technicality, they cannot produce the necessary documentation. That is why the amnesty will be given to them since people have no doubts on their heritage.

Mick Pennisi is a question though. Reportedly, he got the necessary documents to be reinstated. And since he already played for the national team, he might be also be given amnesty. The question is, should he?
  • anong amnesty amnesty
    sinong may pakana nito?
    at sinong teams ang makikinabang?
  • KobeWanKenobiKobeWanKenobi PEx Influencer ⭐⭐⭐
The obvious beneficiary is Eric Menk. Among the Fil-Ams only Menk, Chris Jackson and Rafi Reavis are suspended for not yet submitting the necessary documentation. However, among the three, only Menk has played for the national team.

A possible beneficiary is Rudy Hatfield, only if he fails to produce all the necessary documents needed by the PBA. However, having proven his nationality with the Department of Justice, it could be possible that Hatfield already has the necessary documentation and would not need amnesty.

Again, the amnesty only covers players who have played for the national teams. So Fil-Ams who have not played for the national team will not be covered by the amnesty.

after the long debates, suspensions, court orders etc., i'm all for it.

But make sure that this doesn't happen again. Before the draft all parties should speak up or forever hold their peace.
  • oo nga naman ok lang yun kasi palugi na ang PBA kailangan na nilang gumawa nang paraan. biruin mo 15 peosos na lang ang ticket hehehe

saka sana nga last na yan maging mahigpit sila sa susunod.

this is what i was telling kaboom! some time back. as the pba's mktg mgr, he was bound to the company line: the govt decides.

of course, i was personally sick and tired back then of the govt flip flopping like it does when it sees the color of money, and it degrades the pba to flip flop along with the govt, but kaboom! couldn't see it that way.

as far as the pba is concerned, all it has to do is sway with the government. which only makes it look like it cannot decide for itself. when it has the power to do so as an independent body, which the amnesty talks so prove.

marami naman talagang banas na dyan e.

    basta laro na!
  • amnesty dapat sa rest of the big seven (harp, ordonio, crisano, hatfield) at menk. ang tagal na nilang nasa liga shempre maaapektuhan ang PBA kung bigla silang mawawala. tingnan mo yung games ng redbull nung mawala si pennisi at harp biglang tumamlay. ok naman si rico villanueva pero mas formidable sila with mick and von in their line up. and when they started losing, it just wasnt right. same deal with coke. they were forced to trade jeff cariaso when they lost rudy. crap like this shouldnt be happening. why cant they just play basketball and do away with all that politics? tsaka yung DOJ, wala naman silang jurisdiction baket sinunod ng PBA? diba abugado si Eala? baket di nya nakita yun? o abuga-abugaduhan lang si Eala at wala naman talaga syang alam sa batas kaya nalusutan sya nya? nasira naman lang tuloy mga career ng ibang fil-ams eh kawawa naman.

    cheers
  • Giving amnesty is tantamount to saying that a wrong has been done. It is practically saying that indeed, there are fil-shams in the PBA. There are ineligible players in the PBA. The PBA has eligibility problems.
What do you expect from stupid "bright boy" commish Eala? He should make the supreme sacrifice to save the PBA.
  • That is tantamount to saying that a wrong has been committed. Kaya nga amnesty. It is practically admitting that indeed there are fil-shams in the PBA. The PBA has ineligible players. The PBA has problems with ineligibility. Why has the newspapers not published reports about this?

What do you expect from stupid "bright boy" commish Eala. Eala should do the ultimate sacrifice to save the PBA.

The amnesty pertains to players who for some reason cannot complete their documents, and yet have played for the national team. That means the beneficiary is actually Eric Menk.

Menk definitely has Filipino blood. The reason why he can't get the proper documents is because his mother gave birth to him when she was already an American Citizen. But everyone knows that Eric has Filipino blood. That's why there's a proposed amnesty.

See the article below for more clarification.
PBA open to review of Fil-fors guidelines
    By Nelson Beltran
    The Philippine Star 10/18/2005

The PBA board of governors seemed receptive on commissioner Noli Eala’s proposal to review their policy on Fil-foreign players but set another meeting next week to further discuss the matter.

The board meets again Monday to look at the criteria to be presented by the league commissioner.

Should the proposal is approved, Eric Menk and Rudy Hatfield are among those expected to gain clearance for a return stint in the league under new PBA guidelines on Fil-foreign players.

Both have been cleared by government offices as legitimate foreign-born Filipinos but have yet to satisfy the PBA with necessary documents for Fil-foreign players.

The league commissioner has said there’s an urgent need to review their policy on the Fil-foreign players following a decision handed by the Office of the President on the case of Hatfield.

"Before we’re overtaken by events, maybe we should look into an amnesty program. Our reliance on the Department of Justice now appears to be misplaced," said Eala.

The courts have recognized Asi using the documents and witnesses he has presented. Whether these documents are fake or not, or whether the witnesses were lying or not, it is still the court of law who has decided he is Filipino. Whether you like it or not, Asi will play in the PBA and there's nothing anyone can do about it.
