1.) may sasakyan na bumangga sa iyo, at
2.) ikaw naman yung nakabangga?

Are there any differences with these two scenarios?

Meron ding nakapagsabi sa akin na between two drivers figuring in an accident, the one holding a professional driver's license will always have a stronger defense (or something like that) over the other who's holding a nonprofessional one. Is this true?

    I doubt there's any addage to the "pro" vs. "Non-pro" thing as there are too many factors that can come into play.

    Either way, both parties have to always alight from their vehicles, get a sketch of the accident layout, etc... If its minor, then you can both make "areglo" instead as to avoid the hassles of going to the police station, photocopying the report forms, filling the forms, returning to the police station later on, etc...

    Whats important is that you always keep your cool regardless of who's at fault. Also, if someone bumps you in the middle of the night under questionable circumstances (dark empty road, etc)... dont alight from your car and drive off straight to the nearest police station and report the incident. This is one common modus operandi of carnappers.

    It's always better if you can save yourself the hassle of going to a police station. Try to talk it over with the offending/aggrieved party.

    Now that sucks... If you decide to "talk it over" would it be possible to get things down on writing so that the person could still be liable should he back out on deal? A paper trail always helps so i guess it would be good to get something on the record (incl. a camera shot of the incident if you have a digicam on you/your phone).

    One of the things I would do is to get a sketch of the accident scene just to show how the cars have been situated in the crash scenario. The cars will not be moved, even by an inch, until after the sketch is finished. Then I'd ask the other party to sign it after signing my own name.

    When the sketch is done at least I would have something to prove that indeed the crash happened.

    There's also a reason why I ask for the offending party's license. I will get all his/her contact details. Of course if the offending party has no license, he/she can be imprisoned for that.

    I don't have the luxury of having a digicam on my phone so this will have to do for now :)

  • I will assume that you got hit within Metro Manila.

    Pano ba storya nangyari? Depende kung hit & run ka at kung meron o walang nakakita habang nakapark kotse mo; kung may compre ka ba na insurance;

    Pag collission naman at nag stop kayo sa kalye, whoever is at fault, remember to keep heads cool, even if the other driver was clearly at fault.

    Let coolness take over your psyche. Even to the point of courteously asking the other guilty driver if he/she or any of their passengers have been hurt, is desirable if possible.

    Pag nabangga sa gitna ng kalye, kahit nakasagabal ka or nakabalandra mga sasakyan ninyo, and if a camera is readily available, start taking pictures, specially now that cell phones are equipped with cameras. Never make an attempt to move any of your vehicles, kesehodang magkatrapik trapik yan, until photographs are taken.

    However, if there is no available camera, then move your vehicles to the side of the road, para makadaan naman mga ibang sasakyan, then ask for the guilty driver's license and list down his/her name, address, date of birth, license number, date of issuance and expiration date in a separate piece of paper, or save it as a note in your cellphone, if it is capable of storing such.

    Therafter, don't return his/her driver's license immediately and politely ask him that you be allowed to keep the same for the moment and direct him to follow you to the nearest MMDA station, or PNP-TMG (Traffic Management Group), which has jurisdiction over the area where you collided. The other driver's presence at the MMDA or PNP-TMG will be the 'ransom', for him to gain back the possession of his driver's license from you.

    Give your assurance to the other driver that you will return his driver's license after both of you have reported at the MMDA or PNP-TMG. If he disagrees with your idea, insist that you keep his license, so that you are assured tha he will follow you to the nearest MMDA or PNP-TMG to report the incident and not just drive away. BE SURE TO PREVAIL to keep his license fo the mean time. If the guilty driver has a companion, ask the guilty driver to have his companion ride with you to the police station, if only to assure him of his driver's license.

    Upon arriving at the MMDA or PNP-TMG, both you and the driver will be asked to narrate in a standard Q & A sheet, the details of the collission, and sketch the street and respective positions of your vehicles when it collided.

    If the other driver does not contest his fault and has a comprehensive insurance, then ask him to just contact at the earliest possible opportunity his insurer, for the latter to shoulder the expenses of having your car fixed, to avoid further litigation, and settle it out of court.

    Get also the contact details of his Insurance coimpany so that you will be able to follow-up your claim from his insurance company. Insist for the guilty driver or his insurance agent to immediately send over a representative from his insurance company to examin and estimate the damage on your vehicle. You may also ask that he instead pay for the "participation fee" of your own comprehensive insurance, if you have one.

    If both you and the guilty driver have no comprehensive insurance at all, ask him for his contact details, Tel. No., and tell him that you will contact him ASAP, after you had the damage on your vehicle estimated from your casa, or other collission body repair shop, or 'talyer.' or you may just opt to negotiate for an on the spot cash payment from him, so that both of you may call it a day.

    If the other driver claims that he has no fault, or worse, that you were the one at fault, then ask the, MMDA officer, or PNP-TMG investigator, to just record you complaint, and have it remanded to the City/Municipal Prosecutor's Office, for the filing of a Criminal Case of "Reckless Imprudence Resulting to Damage to Property.

    If you notice that the guilty driver has conusmed some alcohol, request from the investigator to have the said driver medically examined for alcohol presence in his body. However, even if you were totally not at fault, but you consumed alcohol prior to collission, then you should immediately get rid of that alcohol breath, eat canidies, before reporting the incident. Be sure to act sober while reporting what happened, otherwise, you will be the one cited for driving under the influence of alcohol and be given a ticket, without prejudice of course to your complaint. But this will be used against you eventually if the case reaches in court.

    Since, you are the actual complainant, to the minds of the MMDA or PNP-TMG, your complaint, not the guilty driver's, will be the basis of indorsing the case records to the prosecutor's office, for the finding of probable cause against the other driver for the said collission.

    At this stage, the other driver will think twice about not settling the case out of court, considering that his vehicle will be impounded and that the said driver will be detained, until he posts bail. The said diver will also think about the amount of the bail that he would have to post, that he should have instead used to just pay the participation fee of your insurance.

    Pag Public transport naman ang nakabangga sayo, immediately ask for the contact details of the operator, and negotiate witht the operator for the payment of damages, and not with the driver, unless the latter contests his guilt.

    Remember, the key here is to be cool and polite to the police officer investigating the case, to gain his sympathy. Let the other driver act arrogant is he wants to, but remain cool at all times.

    Ang problema kung hindi nyo gagalawin yung mga kotse nyo, may iba pang loko-lokong pwedeng gumawa ng dagdag perwisyo sa sa iyo.

    Happened to me in my last accident a few months ago. Skyway Bicutan off-ramp. I was getting off, taxi bumped me from the rear.

    While we were making the sketch and talking over the details, a police truck supposedly on red alert swapped paint with my front bumper.

    If I remember correctly, time ito ng SONA 2004.

    In my case, the army... a darn 6x6 truck also sideswiped me along EDSA-Santolan before. I had no way out since it was two-lane portion under the flyover (kahit huminto ako para pag bigyan, natamaan pa rin ako)... of course they won't even stop for you since their convoy is the most important thing in the world. :p

  • happened to us last friday....sa may intersection ng pasay-taft....pinagbigyan na namin yng 10-wheeler truck para nga di na kme magitgit....as in nag-stop na kme ha...kaso nasagi pa rin ng buntot nya yng gilid ng kotse namin...basag yng side mirror sa passenger side...tapos gasgas yng paint sa gilid....badtrip yng driver...ayaw umamin na kasalanan nya...di daw sya magbabayad kc di nmn daw nya kasalanan....kahit na sinabi na nga ng pulis na sya nga ang may fault.....binigay nya yng # ng may-ari ng truck...ng tinawagan naman namin, sabi ng owner la nmn daw ni-report yng driver nila na ganon incident...hayy naku...hassle tlg....

    kainis kc tng mga driver ng mga truck e (pati bus na rin)...ang yayabang umasta sa kalsada pero mga wala nmn pala pambayad.....grrr...

    ^ Kung ako siguro yan, at kita kong epal yung driver (and obviously he's at fault and won't admit to it), susunugin ko yung lisensya niya o kaya pupunitin ko. Even if I don't get a single cent from him or sa amo niya, at least alam kong mahahassle din siya, tsaka alam kong nakaganti ako sa kanya:evil_lol:

  • ^ Yah, todo bosina, that's what I do, especially to bus drivers. Too bad the Vios' horn is puny. If you ride the bus you'd notice those bus drivers drift outside of their lane while their eyes scan the sidewalk for passengers...I understand, it's their source of income but please, don't disregard the lives of others.

    Yeah useless nga ang busina ng Vios. Paltan mo na lang to something louder:D

    Minsan pa yang mga bus drivers na yan mga addict! They drive the bus like they stole it; reminds me of Grand Theft Auto:eek:

    ... minsan nga nakita ko yung bus driver na napapapikit sa sobrang antok! hehe kakatakut (pero kawawa naman sila, talagang kelangan kumayod) talagang kelangan mong businahan ng malakas para magising! basta defensive driving lang, magbigay ka ng buffer/allowance at iwasan masyado magddikit sa mga katabing sasakyan, at dapat nasa posisyon ka na tama palagi... nasa right of way ka dapat para just in case me laban ka! hassle talaga mabangga o maaksidente, magdasal ka na lang ng The Driver's prayer at keep calm always!

  • madalas kc ikaw na nga ang iwas ng iwas...pero sila nmn ang dikit ng dikit sayo...hilig mangain ng lane.....badtrip tlg! and nung accident, kuntodo busina na tlg....halos mapaos na nga kakabusina yng kotse e...:D pero hayy naku....di na naman ako naghahabol na magbayad pa yng driver na yun e...side mirror lng nmn...pero sana man lng aminin lng nya na fault nya yun.....

    Should be around PhP1,000 if I still remember correctly
