    Does the Cybercrime Bill complement your rights as a Filipino citizen? Why or why not?

    This law gives too much power to the government. The takedown clause will be abused and only then will people see that this is online martial law.

    This has to be the most important piece of legislation ever. This is particularly significant because the president can now be shielded from being called abnoy, penoy, panot, bakla, inutil and tamad, among other apt, i mean, unkind descriptions.

    Nice to know that congress and the president know their priorities. FOI can rot in hell

    I don't understand how they can give so much attention to this issue, yet the real problems of the country remain unsolved. Maybe if they spent as much time solving problems like unemployment and insufficient school funds, we can actually get somewhere.

    As for the bill, I think it's just one more step towards another round of dictatorship. They encourage us to be open (since we're such a democratic country), but they shut us down when they hear things that are honest albeit harsh. Are we free citizens or not? Make up your minds!

    Cybercrime bill has a positive side, especially if there are netizens bullying, trolling or spreading lies about you. You can file a case against them..

    I will limit my post to the libel provision and sec 6.

    The libel provision and Sec. 6 itself is problematic. It can be abused by ANYONE because the law does not provide a rule on venue of the criminal action for libel and defamation, as covered by Section 6, hence anyone can file a criminal case in a VERY inconvenient forum (Batanes or Sulu for example).

    Also, Section 4(c)(4) or the libel provision is unconstitutional because it does not define online libel (lets call it SOTTO-LIBEL, parang SOTTO-COPY ). neither does the law provide for its punishment, hence its invalid.

    Another question is this: once you been convicted under Sec. 6, does that mean that you can be convicted of another crime under the Revised Penal Code? If so, is that not violative of the rule against double jeopardy since the elements of the crime under the Revised Penal Code is the same as the elements of the crime under this new law?

    Next, this law does not include criminal intent as an element of the crime since its a special law. The mere act of posting or communicating a "libelous" or "defamatory" remark will be enough to convict the poster. So this law, in effect, MUMS our freedom to criticize in general. Be it constructive and done in good faith.

    Also, the Revised Penal Code is enough to protect one's right against libelous or defamatory remarks in the internet.
    All you need to do is file a case and prove CRIMINAL INTENT. So there is no reason for Congress to insert the libel provision and section 6 under the new law. Plus, the Revised Penal Code provisions provides for strict rules on venue of the criminal action which ensures that it cannot be used to harass anyone.

    Finally, the trend nowadays is to impose fines, as against imprisonment, for libel and defamatory cases. So the fine under this new law is dangerously HIGH. Enough to make small and medium newspaper companies and reporters (mainstream and online) to think twice before printing or posting an article criticizing a person worth criticizing.

    So the aforementioned provisions of the new law should be scrapped!

    INFORM YOURSELVES! These are the possibilities that can happen with the current Cybercrime Act. For just sharing or retweeting something online that contains criticisms - you can get jailed for 12 YEARS.

    Let me just point out that we need a Cybercrime Prevention Act. However, the inclusion of these problematic provisions on cyber-libel will just curtail a fundamental principle of good governance: CITIZEN PARTICIPATION.

    ^^ dapat nga between private persons lang ito. or kung applicable man sa isang public officer/employee eh dapat yung criticism eh without relations whatsoever to his/her public functions. otherwise stated, kung yung criticism pertains to his official functions, there is no crime to speak of. but when the criticism is merely an affront on his person, criminal liability attaches.

    It seems like the PIFA will be doing a Rally tomorrow in regards to this Law.

    This Law seems like it was not thoroughly thought of, like it was just signed and was never viewed, in contrary to what the higher-ups wants us to think about it. After reading all articles about it and the Law itself, and consulting some Lawyers, I'm convinced it's some form of Online Martial Law in the case of, the Government can and will be able to just pick You up anytime from the Privacy (Note, privacy), of Your Home and immediately put You in Jail for a simple post of criticism that You post in a Social Media Network or any place in the Web.

    That's like we've traveled back in time to when You can also be dragged out of Your Home and be put in jail for speaking Your mind about the Government back in the days of Reality Martial Law.

    Well, this might be the last time I would speak about our Government again, since anything You say on and after October 3 could be considered Libel.
