Come on folks, stop arguing with someone with an IQ of a pre-schooler. Sayang lang ang oras at brain cells niyo.
It's like teaching a grade 1 student calculus. Utter waste of time.
He doesn't even read our entire posts, he reads the first line then replies in an idiotic manner.

of course while in power, tinatakpan ang mga ginawa. saka na pag may papasok na ibang officer na minsan karibal or something saka na na-e-expose lahat
btw, PENDING charges yan a long time ago, ngayon lang ma file dahil mag retire na sya at di na protected
so you were saying?
yohooo djaynitor andyan ka pa?
Cleaning Executive Officer
hay nako, djaynitor, just because it's not reported on national television eh walang nangyayari na kaso
eto o, class action suit ito
http://philippinelawcases.blogspot.c...-329-scra.html
Bureau of Customs vs. Ogario, 329 SCRA 289 , G.R. No. 138081, March 30, 2000
G.R. No. 138081 March 30, 2000
THE BUREAU OF CUSTOMS (BOC) and THE ECONOMIC INTELLIGENCE AND INVESTIGATION BUREAU (EIIB), petitioners,
vs.
NELSON OGARIO and MARK MONTELIBANO, respondents.
http://philippinelawcases.blogspot.c...-329-scra.html
again DO YOUR OWN RESEARCH
hay nako, that class action suit in a nutshell
the BOC halted the unloading of the rice with allegations na "smuggled" ang rice, indirectly nanghihingi sila ng lagay para ma unload ang rice kahit na di naman totoo na smuggled ang rice
nanalo ang plaintiff btw, defendant ang BOC4.) That upon arrival of the herein-mentioned sacks of rice at the PIER 5 of Cebu City, Philippines on the 7th day of December 1998 all of the defendants rushed to the port with long arms commanding the plaintiff's laborer[s] to stopped [sic] the unloading of the same from the vessel named M/V Alberto. The defendants alleged that the herein-mentioned rice were [sic] smuggled from abroad without even proof that the same were [sic] purchased from a particularly country.
seriously, do your own research.
maraming cases na ganyan, most of them are not reported on national TV dahil damaging naman talaga on the part of the Gov't
most of them are found in local newspapers
try to read the business area, most are written in legal jargon
furthermore, some feel the legal expenses to fight with BOC are too high to justify the shipment in question
my personal experience during the time when havianas were very popular and not yet sold in the Philippines. An aunt of mine sent me a pair that costs only Php 1,500 (USD converted to PHP) the BOC did not release the item and were charging me Php 2,000 just to claim the pair of slippers.
Cleaning Executive Officer
wow, i'm starting to think na imbecile ka nga
1. not all suits end up in jail, at worst the losing party PAYS fines
10.) That by way of example or correction for the public good and to deter the defendants from doing the same acts to other businessmen, defendants should be held liable for exemplary damages in amount of not less than One Hundred Thousand Pesos (P100,000.00).
http://philippinelawcases.blogspot.c...-329-scra.html
2. As I've posted, the BOC is not doing anything illegal by withholding his signature. nagpapahabol sya sa mga negosyante.
and again, do your own dang research marami dyan PENDING pa most especially with cars, equipment and even ordinary items found in BALIKBAYAN BOXES
as for Haagen Daz, it was the article that presumed of the BOC corruption. read it again. walang official statement from Haagen Daaz denouncing BOC, awright?
reposting for posterity's sake
included information about the title and the author
klaro na djaynitor? "our sources said" is not the same as "official statement"
Cleaning Executive Officer
you were also one of the people who substantiated that rumor.
pero as far as "chismis" is considered.
"Where there's smoke, there's fire"
Anyways, totoo ang tariffs of items. In fact the BOC can "talk" to importers and "haggle", totoo yan. Even Biazon himself admits that the BOC can be corrupted
http://www.manilatimes.net/index.php...bsolete-biazon
Current Tariffs Code obsolete –Biazon
....
“One of the loopholes of the Customs system is the opportunities for connivance between importers, brokers and Customs personnel,” Biazon said, adding that less person-to-person transactions would mean less smuggling and less corruption.
....
So does that answer everything djaynitor?
Gahd! Some people just won't shut up.

Sorry offTopic but I just can't help it.

The businessman has no sworn duty to enforce the republic's laws. The custom's official, however, does.
Like I said in an earlier post, corruption can only be cured if the customs officers are held liable for it.

i guess naunahan na ako ni kuro hehehe
now to leave this thread while I enjoy my bread with IMPORTED Nutella chocolate spread *yum* kain tayo
*as kuro stated it already, di na ako mag post ng Republic act that criminalizes bribery lol
Hindi ako sang-ayon for reasons I already stated: Going after private individuals will not solve the problem. They can stop bribing all they want, but unless the BoC reforms its people only the businessmen will be losing.
Until the system stops rewarding people for taking a risk of committing a crime nothing will happen.
. Just for reference of djaynitor, it's in the Anti-Graft and Corrupt Practices Act. Section 4 (Prohibition on private individuals).

i already told you djaynitor... maraming cases against BOC hindi lang televised. if you want, access any law library and take a look at thousands of cases against BOC officials.
siguro naman kung may kaso against BOC, it means the businessmen did not tolerate BOC asking for "lagay"
as for this thread, we are debating the article written by Inquirer
you're the one who pulled the bribery-BOC thing into this issue
Ang punto ko FEW AND FAR BETWEEN ang mga kaso laban sa BoC....

again, check the law libs
as I've said, just because hindi naibalita sa TV, it doesn't mean na KONTI o WALA
just imagine kung lahat ng law suits ibalita sa TV. magiging 3 hours a day ang isang episode ng TV patrol just for the reporting of law suits.
and kung merong katiwalian, tama si Kuro, in terms of responsibility, mas may pananagutan ang BOC compared to businessmen.
so can you take a hint already?
