    So magiging basically arawan na ang mga bus drivers? Kung current minimum wage lang for the first 8 hours (then commission basis beyond that) di kaya mas maliit ang take home pay nila? Remember, walang driver na kayang mag-'straight"- i.e., work 5 or 6 days continuous. Di sila tulad ng ibang minimum wage earners na Mon-Fri/Sat, 8am-5pm ang pasok.

    Will they also offer the same terms to relievers- those who are in their lingo "ume-extra"?

    magkano naman kaya ang magiging daily income ng mga bus drivers pag nagkataon baka para silang mga managers baka 1k per day. Di naman siguro sila papayag nababa ang income nila sa 800 per day.

    For provincial buses this might work especially those on the CALABARZON. Regular naman ang biyahe sa mga ganito and may tamang sakayan ang karamihan sa mga to. Ewan ko lang samga dumadaan ng EDSA kasi parang patayan pagkuha ng pasahero dun. Ayusin din sana muna ang babaan ng passengers ng bus like sa LRT Buendia. Napakahirap na maghanap ng taxi, jeep and even LRT ride simula nung pinasara ni Lim ang Lawton para sa karamihang bus.

    Bus operators ask SC to stop 'fixed salary scheme'

    Four groups of bus operators on Wednesday asked the Supreme Court to stop the Labor Department and the Land Transportation Franchising and Regulatory Board (LTFRB) from implementing the fixed salary scheme for public utility buses this month.

    In their 22-page petition, the bus operators said Department Order No. 118-12 Series of January 2012, and LTFRB Memorandum Circular should be declared "unconstitutional, null and void, and shoulde be recalled."

    The petitioners were the Provincial Bus Operators Association of the Philippines (PBOAP), Southern Luzon Bus Operators Association (SOLUBOA), Inter-City Bus Operators Association (InterBOA), City of San Jose del Monte Bus Operators Association (CSJDMBOA).

    The petitioners asked the court to issue a temporary restraining order and a writ of preliminary injunction against the DOLE and LTFRB orders on the fixed salary scheme.

    The petitioners also asked the high court to order a status quo, restraining the respondents from implementing any other issuances that may arise from the assailed order and circular.

    'Risk-taking behavior'

    In a memorandum circular released early this year, the LTFRB said the “risk-taking behavior” of bus drivers can be attributed to their “lack of income security under a purely commission-based compensation scheme.”

    Bus drivers got paid depending on the number of passengers that ride their vehicles, or the number of trips they manage to complete on their routes.

    To try to address this problem, Labor chief Rosalinda Baldoz issued Department Order 118-12, seeking to institutionalize fixed salary rates for bus drivers and conductors.

    But in their petition, the operators said the new scheme will "force [them] to abandon their existing employment arrangments with their respective drivers and conductors... or such other time-honored arrangements that had long existed since time in memoriam."

    Under current collective bargaining agreements, drivers and conductors receive salary on a "payment by results" or "commission basis."

    But under the new wage scheme, bus operators have to provide their drivers and conductors with income not lower than the minimum wage.

    Also, they are also required to give added performance-based pay based on their productivity, safety performance, business performance and other related parameters.

    The petitioners said the new scheme was "clearly, unconstitutional as [it does] not only create obligations between the aforementioned parties, without either of them agreeing thereto, but [it] also instead, impairs upon such obligations earlier entered into by both the aforesaid parties mutually," the bus operators groups said.

    The groups said the new scheme takes away the rights conferred to them as contracting parties in their respective agreements with drivers and conductors.

    They also said the DOLE order and LTFRB memo violated their rights to equal protection of the law, since the scheme would only cover buses in Metro Manila and not other buses in other parts of the country.

    The petitioners insisted that provisions in their respective collective bargaining agreements have "better or more benefits [and are] products of intense and lengthy negotiations between petitioners as employers and drivers and conductors [as employees]."

    The scheme was implemented in light of a DOLE survey showingt that PUB drivers tend to work 17 to 19 hours a day just to earn money under a "commission basis" system.

    The government also hoped to reduce bus-related accidents on the roads through the fixed salary scheme. The salary regularization was a proposal of the Metro Manila Development Authority.

    But the bus operators insisted that the number of bus drivers and conductors "complaining of their compensation is not that alarming."

    The petitioners also stressed that there is still no "scientific or proven connection" between a bus driver or conductor's salary and incidents of road mishaps. — RSJ, GMA News

    Everyone has to follow the minimum wage law. The bus companies shouldn't be exempted.

    "time-honored arrangements" doesn't excuse you not to follow the minimum wage law. If the supreme court grant you an exemption then shouldn't factories disregard the minimum wage law and start paying on a "per item" basis because it's also a "tradition"? There's a long tradition of slave wage in the Philippines. That is why we have a labor code. Nice try.

    Perhaps the greatest solution to the traffic problem is to just revoke all bus franchises and just nationalize the public transportation system. The constant transport strikes can be averted at mawawala na ang mga kolorum.

    Mahirap talagang kastiguhin ang mga private bus companies na eto. Kaya naman maayos ang patakbo ng mga PUB's sa ibang bansa kasi gobyerno ang nagpapatakbo. Walang unahan sa pasahero. Sumusunog ang mga drayber sa batas sa kalsada.

    Simpleng enforce lang ng LTFRB and LTO ang mga patakaran nila aayos yang mga bus na yan.

    If you can't rely on the government to enforce its regulations how do you expect it to actually run the bus transportation system?

    marami pa kailangan action/baguhin with those road accidents involving kaskasero bus drivers, i'd prefer lessening their driving hours from 12 to 10 hours with a 1 hour break, at malaki parusa sa mga reckless drivers, revoking their license totally, with no chance at all to renew, gaya ng nangyari sa EDSA ortigas.

    O kaya inationalize ang bus system sa Metro Manila tapos 2 companies nalang magooperate, example like SBS Transit and SMRT Corporation in Singapore.

    At sana lahat ng bus ay BRT type

    malaki parin ang factor ng pagiging arawan ng mga driver dahil sa kagustuhan nilang kumita sisiksikin talaga ang bus hanggang maging dalawang linya na ang nakatayo at wala ng madaanan yung bababa. hindi naman makakapasok ang pasahero kung di bubuksan yung pinto ng bus. may time pa nga na malalate ka sa opisina dahil yung bus kaya standing na kuha parin ng kuha ng pasahero.

    I agree magkakaroon talaga ito ng effect sa mga drivers..their mindset wil change from being passive to pro active and start to care for the passengers as they will feel pride in their job..hindi katulad ngayon na puro commission basis na lang kaya padamihan ng nasasakay..there was this instance in cubao that I waited more than 10 minutes on the back of a bus and to my surprise there is nothing in front of him that blocks his way he is just getting passengers..I honk it and snap headlights on and off to no avail....to my anger I got off my car and went straight to the bus drivers window and knock and said.."LALAKAD KA BA OR PILITIN PA KITANG UMALIS DIYAN SA UPUAN MO???!!!" this elicited an immediate realization to the driver...

    I mean the operators should start caring for the commuters and the drivers rather than just keep thinking about how much money they will rake in!! tapos ang kakapal ng mga mukha na mag file ng injunction eh hindi naman nila pinaayos ang mga bus nila..dami pa colorum....
