Unhappy All about Contract - How...

    Hi everyone,

I have a problem, I signed a contract to another company but my current company gave me a counter-offer. Can I still back out to the new company though I already signed the contract? I read the contract and they have a Bond, do I have to pay the bond if ever I back out? Help guys!

Any other info that you can add guys are very welcome.

    That's Breach of contract

If you've already signed with them, yes, I think you have to pay if ever you back out..

Do they have the right to sue me?

If you back out and don't pay, yes, if you've already signed a contract with them. That's a breach of contract. Try to review what your contract says.

That's you not doing your part in a legally binding agreement.
In theory, they have all the right to sue you.

But, then again, that's the theory.

I read that breach of contract does not exist since I have not started working with the company yet.

    @TS

Mismong contract na talaga ang napirmahan mo? Baka job offer pa lang yon.. hehe
Kung mismong kontrata alam ko di ka talaga makakapagback out ng basta basta lalo na pag may training bond or alike.

pagkakaalam ko, pag napirmahan mo na ang job offer in a company ayos lang magback out as long as HINDI ka pa nakakapag-render ng duty, pero pag nakapasok ka na, ibang kaso na.

    Sa pagkakaalam ko lang ha

Art. 1315. Contracts are perfected by mere consent, and from that moment the parties are bound not only to the fulfillment of what has been expressly stipulated but also to all the consequences which, according to their nature, may be in keeping with good faith, usage and law.

will he get sued or will be asked to pay immediately the moment he announced that he will not pursue that company? wala bang warning man lang ? Hindi ba pwede na advise na yung company then kung i-threaten siya na may penalty then saka na i-honor yung contract? Based from the responses kasi, it seems like the "only" option is either to pay or honor the contract.

Since you've mentioned that, what would be the best way to tell the company that you wanted to back out?

    a straightforward answer always works.

"I've decided to rescind the contract because I have my goals and family to consider..." blahblah

I'm not sure kung magbabayad pa, actually hnd ko na alam kung ano pang mangyayari. Just hoping na sana wag nang lumala pa. I really learned something from this experience. Sana tama ang desisyon ko to stay..
