I am inquiring if we have any labor laws na I could use because I want to complain the way our office handled my issue.
I work for a bpo, non-staff position and was given a 10pm shift. I figured it was okay because I was feeling much better after a month's leave of absence due to a difficult 1st trimester. But I started having dizziness everyday until last Wednesday hindi na ako makatayo sa hilo. So I was picked up by our office nurse sa sleeping area ko and was given an oxygen in the nurse's clinic. The doctor wanted me to be rushed sa ER kapag hindi nag subside ang hilo but I wanted to eat first. After eating, nabawasan ang hilo ko and decided to go home with my husband kasi that was 5am in the morning na. 2pm pa ang schedule ng ob ko sa clinic nya so I had to sleep and wait muna before going there.
Upon seeing my ob, she gave me a med cert stating na I could work madaling araw, mga 3am-4am kasi yun yung usual sleep pattern ko. My boss received that med cert and allowed me to rest that day. But next shift, which is 10pm, she texted me, I expect to see you at 10pm.
She replied: Your team's schedule is 9pm-6am, do you have fit to work clearance from your doctor? (as if hindi enough yung med cert na binigay ko sa kanya)
"If you can't make it tonight, I will have to tag that as SL"
(which is really unfair because I can go to work nga eh, but not 10pm, madaling araw kaya ko, not gabi. And besides, unpaid sick leave yun dahil naubos nga ang sl ko sa leave of absence ko a month ago.)
I replied of course saying, the same thing - i can work but not AT NIGHT. Hindi po kaya ng katawan ko.
I RECEIVED NO REPLY.
I texted again yesterday, Sunday afternoon AFTER I WENT AGAIN TO MY OB to get another med cert to back up the first med cert I submitted. Still, NO REPLY FROM MY BOSS.
I want to sue them but can I? what labor law can I review?
