    Ano ang pwede ikaso sa mga chismosa?

    We had this staff kasi na natanggal sa work dahil nga sa sobrang chismosa. Ngayon dahil natanggal siya, naghihiganti siya sa mga dati niyang co-workers. Kung ano ano ang pinopost niya sa facebook na talagang may mga pangalan pa ng mga dating co-workers niya at sinisiraan ng sobrang personal. Minsan nilalagyan pa niya ng picture with nasty comments. Minsan narinig ko na nag-away daw ang isa sa staff namin at asawa niya dahil nga daw sa mga pinagpopost nung chismosang babaeng yun.

    Ano ba pwede ikaso? At pwede bang ireport sa company kung saan currently working yung chismosa na yun?

    Baka pwede ang libel, since naka post sa FB, kaso lang ang hirap patunayan na siya nga talaga yung nagpopost doon, pwede kasing idahilan, na na hacked ang account niya or bogus account yun, para siraan siya.

    Antayin natin ang mga magagaling sa law na mga pexers.

    Sa isang workplace kasi eto na kung saan eh meron kaming mga regular clients na bumabalik every week. Ang ginawa nung natanggal na chismosa eh inadd niya mga regular namin na mga clients para mabasa nila yung mga posts niya about sa staff. Kaya minsan nagtatanong na lang yung mga clients namin kung totoo ba na si ganito eh ganyan. Nakakaapekto na sa mga work nila.

    And another thing is that meron daw "friend" yung natanggal na chismosa na nasa company pa din namin na kung saan eh nagkakausap sila minsan at sakanya nga kinikuwento yung mga kasiraan na pinopost din niya sa facebook.

    LIBEL. Heck... pwedeng gamiting ebidensya yung mga pinost niya online since written or publicly published yung paninira niya... may precedence na sa america.

    mahinang pang-depensa yung deny. Yea... pwede nga niyang ikatwiran yung na-hack siya pero sino ang may pinakamalakas na reason o intensyon para gawin yun? bakit naman gagawin ng iba yun and assuming may nang hack ng account niya para siraan lang siya... bakit may magsasayang ng panahon i-hack yung account niya para lang siraan siya? when a person is denying an allegation, you establish among other things: motive, intent, person's location and access to the source IP of the computer used during the postings.

    with proper questioning inconsistencies on statements can be identified and the truth will come out... may mga lawyer nga minsan na sobrang galing... kahit hindi ikaw gumawa.. sa galing ng questioning... mapapaisip ka na baka ikaw nga ang gumawa.

    a couple of things to consider... yung idi demanda mo ba ng libel... kaya magbayad ng damages laban sa inyo? do they have enough wealth or property to pay o baka magsasayang ka lang ng panahong magbayad ng abogado at court fees para maghabla... unless na sobrang detrimental na ng pinag gagawa niya at napatunayan na nawawalan ng pera yung kumpanya then baka worth it... there are cheaper alternatives to bring a person like this down and one of the more obvious ones is to ignore the chismosa. cease and desist letters are also cheap and very effective.

    meron din akong supervisor na naknakan ng chismoso, kalalaking tao pa naman at napaka chismoso talaga. Baka 'yan din ang gawin niya pag natanggal siya sa trabaho.

    civil case ang pdeng ikaso sa kanya! at bakit nde man lang imbestigahan ng current employer nya bago sya hinire.. siguro sa mga pipitsuging company lang sya nagwowork..

    Are you in the Philippines? Check to see if cyberbullying is illegal there. And check with HR if it's legal for the company to tell her current employer about it.

    You gotta prove it. Otherwise you're wasting your time---even if you won the lower courts you won't the higher---they're gonna be looking at the public repercussion of the decision (every motherfcker would be suing for every chismis). And then also, unless it's libel which is easier to prove and usually have bigger gains $$$, you'd be dealing with freedom of speech (also part of public repercussion that a smart Supreme Court judge wouldn't want to mess with).

    All in all unless you're putting it against someone with huge bank accounts, that would pay up, it's a waste of time and of your money (attorney fees). Even then if you win, and with $$$ most of it will go to your attorney. It's easier to teach someone a lesson say burning his/her house. Or the mature way: just ignore it. In reality if the people you care about listens to such falsehoods and believe it, then you have bigger problem than having enemies (aka bad friends).

    We had a similar case in my former office. The disgruntled employee created accounts in public sites using the name of the officers and sent lewd materials to the employees (he knew our naming convention so he was able to send to many). We were able to trace the ip address he was using. He was sending the emails during office hours using the ip address of the current employer. We just set a meeting with his current boss and HR officer and discussed what their employee was doing to us and the impact on their office. It solved the problem.
