    Spousal Support

    Good day PEx-ers! I hope someone can advise me on this.

    My husband and i have decided to end our marriage but we have not decided whether to get an annulment or what. He is a US Immigrant and is working there while i am left here in the Philippines to pursue a degree in Nursing.

    I have quit my job since we got married so i can focus on school. But since we decided to end it, can i ask for spousal support from him for my tuition fees and needs as well as of those of my kids? The kids are not his but they are really close. Will it be possible for me to ask support from him? Or will i need a lawyer in tne US for that?

    There is no provision of ALIMONY under Philippine law ... GOOD LUCK chasing him for that....

    But it says in the Violence Against Women and Children Act that economic abuse is considered an act of violence against women amd children.


    D. "Economic abuse" refers to acts that make or attempt to make a woman financially dependent which includes, but is not limited to the following:

    1. withdrawal of financial support or preventing the victim from engaging in any legitimate profession, occupation, business or activity, except in cases wherein the other spouse/partner objects on valid, serious and moral grounds as defined in Article 73 of the Family Code;

    2. deprivation or threat of deprivation of financial resources and the right to the use and enjoyment of the conjugal, community or property owned in common;

    3. destroying household property;

    4. controlling the victims' own money or properties or solely controlling the conjugal money or properties.

    In #1, it states that if he withdraws financial support or preventing the victim in engaging in any legitimate profession or occupation. My husband made me resign from my job so i can take up nursing. So i have no income now since i am back in school. I still cant ask him for financial support?

    I'm amazed that you'd still have the audacity to ask your 'ex'-husband for financial support for YOURSELF when you guys have decided to separate already.

    If you guys are separated na, why oblige him to support you?

    Because after the wedding, he asked me to quit my job so i can go to nursing school, which is what i am doing now and i really do plan to finish it. Since i have no source of income already because i am back in school, how can i pay my kids' tuition fees and their needs as well as my tuition fee? I was earning well with my previous job and since we plan to live in the States, he told me to quit my job, take up nursing because it is better for our future. I saved all his emails and messages that says he will support me financially until i graduate.

    And its just not for MYSELF. I have two kids who are in school and they have needs, too. If i didnt have kids, it would be a different story.

    Thank you sa reply. And yes, maybe the best thing to do is consult a lawyer about this matter.

    Why would he even be compelled to support his ex-wife and two kids that are not his?

    If those kids were his, you can ask help from the US embassy and file for child support and child services will have his salary automatically deducted and sent to you. But unfortunately they are not his so nothing will compel him to support your children.

    Alimony is another thing, that has to be awarded by the US court. And if you're going to file charges against him here in the Philippines good luck making him come back.
