    What should I know before buying a lot?

    Hi, hingi lang po ako advice, bali ganito scenario:
    May binebenta pong lot, kaso yung may-ari ay nasa abroad. So yung kapatid nya yung nag-aasikaso.
    Pano po ba ang process sa pagbili nung lot? Gusto ko po na makasigurado na clean title, at hindi fake.

    This is a potential scam. 'Yung ibebenta siya without the owner's consent, or much worst, baka up for foreclosure na ang property. Kinakailangan talaga ng tulong at gabay ng isang real estate agent dito, at ng isang lawyer, para mapagtibay ang transaksyon.

    Dapat may kasulatan na ang property talaga ay ipinagbebenta sa kaalaman ng may- ari. Mas maganda rin kung may magaganap na transaksyon sa pagitan nila ng buyer. In this case, mas makasisiguro tayo.

    Kung ako ang tatanungin, mas mabuti mag- invest ka na lang sa kilala at dekalidad na developer. Mas mapgtutuunan pa ng pansin ang concerns mo. Katulad ko, nadala na ako sa mga scams na 'yan. 'Yung una, naloko sa isang Internet post at pangalawa, itong mismong thread natin. Kaya naman minabuti ko ng bumili sa inirerekomenda ng marami, DMCI Homes.     Acquiring real estate property is sensitive. As much as possible, we avoid experiencing a bumpy road, because it would mean delay in process and money. That is why we are entitled to a lot of options out there. Before we buy a house, we must remember to:

    1. Make sure that the "Transfer Certificate of Title" is authentic. The easiest way to check if the title to the property you are buying is authentic is by getting "Certified True Copy" of the title from the Register of Deeds.

    2. Verify that the title is clean, meaning the property is not mortgaged (no liens & encumbrances on the property).

    3. Make sure that the land described on the title is really the land that you are buying. You can validate this at the Register of Deeds or by hiring a private land surveyor or a geodetic engineer.

    4 Confirm that the yearly real estate taxes are paid. Ask for certified true copies of the Tax Declaration and original Tax Receipts to confirm that real estate tax payments are up to date.

    The construction of the Torre de Manila has been accepting many criticisms now. Netizens have been protesting against this latest DMCI project near Luneta Park as it will ruin the beautiful sightline. I haven’t heard of DMCI Homes’ answers on these violent reactions. How will DMCI face this situation?

    Saan ang location ng property? Ganito ang gawin mo, para makasigurado ka sa binibentasa iyo:

    1. Hingi ka ng Consularize Special Power of Attorney na Authority to Sell from the lot owner na ina-allow niya iyong kausap mo na pinapabenta niya talaga iyong property niya doon sa kausap mo.

    2. Para makasigurado ka naman na hindi peke iyong binibenta sa iyo, hingi ka ng Certified True Copy sa Register of Deeds ng lot na binibenta sa iyo. Nakalagay na rin doon kung clean title ito.

    Para makasigurado ka na pinapabenta talaga iyong property sa kapatid niya, hingin mo iyong contact number ng owner para makausap mo siya ng personal.

    Saan iyong location ng property? Kung paano malalaman kung clean title, pumunta ka sa Register of Deeds then hingi ka ng Certified True copy ng title (ibibigay mo iyong TCT No. sa RD staff in-charge). Nakalagay doon kung nakaloan o hindi iyong property at name ng owner.

    Punta ka rin sa City Hall o munisipyo ng bayan na nakakasakop sa property na bibilhin mo. Punta ka doon sa bayaran ng Realty Tax then itanong mo kung clean title ito (ibigay mo iyong TCT No.) o hindi nakakabayad ng realty tax. Kung may utang naman, alamin kung magkano, pwede naman kasi na bayaran iyon ng owner kapag nagkabayaran na kayo sa bibilhin mong property.

    Para malaman iyong Realty Tax, doon mo rin itatanong sa City hall o munisipyo, sa bayaran ng Realty Tax.

    Good day everyone, we are planning to buy a residential lot in QC about 175sqm. The copy of TCT got burned in Registry of Deeds on 1988 and the owner (still has the original title) has not yet reconstituted the title. The owner has not yet also transfered the title to her name and it's under Sta. Lucia realty. We have checked with the Sta. Lucia to check the records and we have confirmed that indeed it was sold to the owner back in 1987. However, the owner is already dead and the son is now the one selling the property. They are only in the process of producing the Extrajudicial particion, which according to them will take about 3 weeks to complete.
    Question Masters, once the extrajudicial is complete can we now purchase the property even if the reconstitution is under way? what are the risk of purchasing a title that is yet to be reconstituted? how much is the cost of reconstituting a title and how long does it normally takes?

    Thanks Client_Magnet. Just a way to help people. If you have any more queries concerning real estate properties, you can just tag my name so I can be notified. This actually made my day.

    To add, sa mga sitwasyong wala ang tunay na may- ari and at times, hindi talaga sumisipot sa usapan, tama ang hinala mo. Be cautious dahil maaaring scam na ito. Remember to always keep track of everything that happens in the process.

    You can always entrust to other developments naman, that offer everything you need, without getting into trouble. One of which is DMCI Homes. I believe that they have great services and they will cater/ heed to any of your concerns possibly in the fastest time. Like I did. I had invested in Cypress Towers 2 years ago, since I moved in to Manila for work. And I am exceptionally pleased.
