I really admire the supreme court. Kahit papano we can still see they are doing their job. Sundin ni Penot yan kundi mas lalong lumala yung drift between executive and judicial branch. Baka in the future ang consequences ng actions niya ay bumalik sa kanya at pati yung bansa ay idamay niya.

SC justices trade barbs over Noy’s Luisita case
    By Benjamin B. Pulta

The gloves appear be off within the high court, with the reported penchant of an Aquino-appointed high court justice to delay her dissenting opinions by refusing to submit her opinions to the majority for the ponente to include her dissenting paper into the majority decision, leading to a heated debate among magistrates.

The reported no-holds-barred debate among magistrates in the Supreme Court has put off handing down a final ruling on the fate of Hacienda Luisita, the sprawling sugar estate owned by the family of President Aquino. The reason for the continued delay was reportedly due to SC Associate Justice Lourdes Sereno’s refusal to submit to the majority her dissenting opinion, then, it is said that Sereno has the habit of alterning her earlier arguments in her opinion piece even after the high court’s vote.

The majority of the Justices were frustrated by the delay in promulgating the decision on the Hacienda Luisita case, which has been left to sleep in the SC precisely because of Sereno’s delaying tactics.

Word has it that in the case of the Hacienda, the majority ruled for the immediate distribution of the land to the Luisita farmes.

Evidently, Sereno’s was a dissenting opinion, favoring the Aquino-Cojuangco family’s move to retain the land.

Court insiders told the Tribune that Sereno also has that habit to release her dissenting opinion to media and separate from the majority ruling.

Early in the day, sources said the Tribunal would hand down a final decision ordering the distribution of the land to tenants actually working the land.

Court Administrator Midas Marquez in a press briefing shortly before the SC held its oral arguments however clarified that no decision has yet been promulgated by the high court.

Independent sources in the tribunal said the promulgation of the decision in the case was delayed after a very heated exchange of words between magistrates which descended into name calling between the justices.

The case had been assigned to senior Associate Justice Presbitero J. Velasco. A verbal showdown between Sereno, an appointee of Aquino and another magistrate ensued however, after the presidential appointee refused to hand a copy of her dissenting opinion.

The source said the justices who make up the majority position in the controversy failed to convince the dissenting magistrate to submit her dissenting opinion so that her arguments could be fully discussed in the ponencia or majority decision.

At one point members of the majority side, the source said, outright accused the dissenting magistrate of deliberately blindsiding the majority with late dissenting opinions while another Justice described opinions of the dissenter as outright “lies”.

The ill-mood between the Justices seemed to continue yesterday after the en banc hearing and into the oral arguments into the Arroyo court.

Let go of Hacienda Luisita para naman me moral ascendancy man lang ang Pnoy Admin.

Well, to be fair, I'm pretty sure kung ibang news outfits ang makauna sa ganitong leaked information ikakalat din nila kaagad. There's always that need to be the first to the news among these companies.
