Last time I heard, they are moving their office but no specific location yet, they are using SSG1 in Mandaluyong as their Marketing office now, I suggest you make your demand letters and have it served personally and make sure it is received and signed on by their OICs. Make clear you demands and ask for immediate actions from pan Asia. And if u are not satisfied on their reply, the I suggest u get a lawyer and file a Law suit against Pan Asia. The sooner the better.![]()

Just an update. I met upwith rad93 on to check on how they are handling this issue and I personally believe that they have the right approach of filing the case against PanAsia. From what we talked about it seems that correct way to go is to file a case so that we can have some assurance that the money will be returned.
Like what tefheta said, having the checks is not enough ... anytme they can close the account. It our hard earned money so lets fine time to facilitate how we can get it back.
I will be following in rad's footsteps and will be using their lawyer as well since he already knows the case and he has the evidences related to PanAsia.
Some of the evidences that rad has is no longer available online (Flyers and ads that they are still using to entice investors even if the building has stop constructions.) So having my case with the same lawyer will be beneficial.

Hi Unit Buyers. Already met with Breakdance 22. An interesting issue was shared by him regarding Pan Asia's office in Sunshine Garden 1 Condominiums in Mandaluyong City.
Just maybe, it's part of Pan Asia's delaying strategies to move to an unknown office unannounced. Maybe, they're just trying to confuse the courts' messengers and couriers as well as the unit buyers who are looking for explanations and demanding for refunds.
Maybe the returned letters or summons to Pan Asia were just to get around with the system to buy them some time and hopefully for the buyers to loose interest due to the burden of hassles and stressful time-consuming legworks and paperworks.
It truly make sense, even if this is just an opinion. Delaying tactics will give Pan Asia ample time to look for loopholes, or remedies for their failure to deliver. Though I doubt they can get away with it.
So I am encouraging other buyers to file a lawsuit against this developer and in case you do, address the summon to Pan Asia/Sunshine garden Condominiums Management/SSG2 Marketing Office at SSG1 Condominiums in Mandaluyong City.
If any letter will be personally delivered, make sure that your letter will be received, signed with date and duplicated or triplicated.

Tama ka, mas serious offense pag nag-bounce ang PDCs nila. It is a criminal case concerning the Anti-bouncing checks law. So if ever, mangyari yun, kasuhan mo agad at wag mo nang bigyan ng 2nd chance. Masyado na silang nang-agrabyado.
Walang balita sa iba kung napano na mga lakad nila, alam ko lang si Mar2012 nakapag-complain na sa HLURB, I just don't know if that is a legal case against Pan Asia he filed, or dun sa mediation ng legal dept. ng HLURB.

Sad to read your problems here re: SG2.
I was supposed to buy a unit here back in 2010 but changed my mind. The only damage I got was the non-refundable Php 10,000 reservation fee.

So to all who's thinking of accepting Pan-asia's installment refund, wag nyo na ituloy, file a case at demand for a one-time payment full refund preferrably in cash! Our cases will be processed faster if the government authorities will see the magnitude of this problem. Eventually, this Movena Cu and all people behind this Panasia will have to surface and face us all.
They definitely have no money guys!

Yes HLURB & our lawyer can help us but we put that on 2nd step, we need TULFO, NBI, O IMBESTIGADOR, because media can help us, surely with all the problems PANASIA is encountering, the Executive VP MOVENA CU, is now planning to go abroad to & will not return to Philippines anymore, just like their president MR. YE, who already left the county. So we just seek for media's help, & let's work out to have a HOLD DEPARTURE for MOVENA CU, then file a case against MOVENA CU together with the managers RICHARD FERNANDEZ, SUZETTE ANDAYA & ATTY. LALLIE MACATANGAY, who not even once attend to our needs, every time we called their office, they are all always in the meeting, when we go to the office, they are not available also, specially Ms. Andaya & Me. Fernandez, when we looked for them at the reception area to the guard on duty, the will tell us to wait, then all of a sudden will say, they are not in the office yet. WHAT??!!!! Stupid Guard or Stupid Managers?

Here are the suggested steps for you to take.
Step 1: Write a letter demanding for Full and Immediate Refund, invoking your right under Section 23 of PD 957 Subdivision and Condominium Buyers Protective Decree. Go to the developer's office and have your letter received by any of their managers. If there is no one who wants to sign and receive your letter, please take note of the name of the person you left a copy of the document with (and their contact information, if possible.) and send an email to their management that you left your document for them to receive.

Non-Forfeiture of Payments
A buyer’s payment for a subdivision lot or condominium unit cannot be forfeited by the owner or developer when he desists paying on the ground that the project is not develop per approved plans and within the time limit for development. He must, however, notify the owner or developer of his decision to suspend payments.
The said buyer has the option to demand a refund of the total amount paid with legal interest. The total amount includes amortization interest but delinquency interest is excluded. Section 23 of PD 957 Subdivision and Condominium Buyers Protective Decree provides, thus:
SECTION 23. Non-Forfeiture of Payments. – No installment payment made by a buyer in a subdivision or condominium project for the lot or unit he contracted to buy shall be forfeited in favor of the owner or developer when the buyer, after due notice to the owner or developer, desist from further payment due to the failure of the owner or developer to develop he subdivision or condominium project according to the approved plans and within the time limit for complying with the same. Such buyer, may at his option, be reimbursed the total amount paid including amortization interest but excluding delinquency interest, with interest thereon at the legal rate.
Step 2: File a complaint against the developer through HLURB (http://www.hlurb.gov.ph/) ASAP.
Step 3: Consult with your lawyer.

My suggestion to all buyers file already a complaint/case. I myself is already a victim of their bouncing checks of the refund they gave me. So do not hope for that anymore. The owners are already planning to abandon the project. So we have to move fast.
As for the employees of Panasia especially the officers, Andaya, Fernandez & Macatangay, you'll be the one pressed in between buyers and the owners of your company, your names and reputations are also on the line. So better give the information of your bosses to authorities before they leave you here and do not let them abandon their responsibilities passed to you. You're always saying you have no control over them, then let them face us and dont hide them from us. Do not hide yourselves, too. Gusto nyo mapasama sa wanted list?? Kahihiyan nyo din to and to your family.
I was due to receive the PDCs for refund last week and was very alarmed when I couldn't get through to their Unionbank office. I found out here that they are no longer at Unionbank. I sent Mr Fernandez text messages, though, I wasn't expecting to hear back from him, he confirmed they're no longer at Unionbank, that they have an office at SG1 but didn't give me their phone number. He also informed me refund and buyers' concerns have been forwarded to their legal, to an Atty Joe Luis Sison with office at U626 Cityland Shaw Tower. I called Atty Sison everyday since Wednesday but can't get a hold of him. It was always the secretary/receptionist, she said she gave Atty Sison my number and told him of my concern but Atty Sison didn't get in touch with me.
This attempt at refund is frustrating and very scary and to learn that the check bounced is another blow.
Guys I would like to join you in any action u will file against pan asia. Just last week I sent email requesting for refund and when I called them last friday till now, no one is picking up the phone.
