    Sunshine Garden 2 (Pan Asia) Unit Buyers

    Any updates on this? Buyers out there, are you still paying the DP for your units? It seems the target date of completion have been moved and moved further into 2012-2013? If you have any knowledge on what's happening, please don't hesitate to share. Thanks.

    Can we all meet and make a formal case against this developer?

    Hi kagebomb and tonytony.
    Pan Asia doesn't even have the courtesy to communicate with buyers as to the status of the "loan" they are undertaking or if this is going to be a white elephant construction.
    I suggest we affected buyers meet. It's been so long, and we need to do action. We can start with a group appeal to DTI, afterall. This developer ought to be taught a lesson on good business oractice and customer service.
    We can devise a way on how to communicate. My other post was infiltrated by someone obviously from Pan Asia. Obviously we all know who that person is. We dont want that to happen in our group com.

    Bumili rin po kame ng unit s sunshine garden and wala po kame balita kung ano n po ba... we just happened to google to find some info about sg2 and find this forum. Actually d po namen alam aksyon gagawin, we're still paying the downpayment pero matatapos n po by March 2012.

    I'm a unit buyer, too and I already requested for a refund.
    I'd been calling their office since last week to ask Suzette Andaya the finance manager on the details of this staggered payment for my refund! Gosh! staggered payment?! But to my surprise no one's answering their phone. I just found out fron Unionbank Plaza's receptionist that their Ortigas office is already locked down and Pan Asia is moving. They are moving w/o any advice to us buyers! I felt that they are running away from us. I called Richard the marketing mgr through his cp and found out they're temporarily using their marketing office at the site in Boni. Luckily my no. is not listed in his contacts so he answered my call. He wont disclose to me their new office as if he didn't know where it will be. He just said w/in the viscinity or in San Juan.

    As for refunds he said the processing will start on Feb. OMG! They are really giving us buyer a hard time. As of now Im already asking HLURB on what to do in case these people really run away. Their no at their Boni office is 470-1874 in case you want to follow up your concerns to them. Buyers let's all talk. Hope to hear from you guys.

    Fellow Unit buyers

    Hi, fellow unit buyers. we too, are dismayed with what's happening with Pan Asia's project the Sunshine Garden II. we are done paying with the Down payment amortization several months ago. my family and I expected that we could move in as early as the 3rd quarter of 2011. what happened is truly inconvenient, frustrating and costly for us. it is an understatement to say that "we had enough." demanding a full refund of our payments, we were neglected and passed on by PAN ASIA's officers without any concrete answer and solution. we decided to file a complaint with the HLURB and determined to go to court for we incurred a lot of emotional stress and our plans were derailed because of the failed promise of turn over.
    If u experienced the same ordeal as we did and want to do something about it but don't know who to turn to, maybe we can help by sharing what steps we have taken. My number is 09325653929.

    hi rad93! i just got back in the office and still haven't talked to Suzette Andaya regarding my refund. I'll try to get to her by monday. She's so hard to reach really. Always out of the office. Perhaps that's the reaon why Panasia started falling financially, the finance manager is always ''out of the office''?! But I was able to talk to a finance staff Rosalie who couldn't give me specifics but she said usually refunds of P200k has a schedule of 8 monthly staggered payments!?!?!?! Imagine how our money will just lay there for months.

    Anyway, how's your case at HLURB? I guess you have to change the address of PanAsia on the documents of your case file to their Boni site since their office in Ortigas is locked down.

    Hi Tafheta, our lawyers are already handling our case, we are from time to time being updated and consulted. we already prepared ourselves for the long strenuous legal battle. But we are confident that justice will be served sooner than we expect.
    Just imagine how long will it take to get your full refund, should their terms will be on installments. When did they promise to start paying you again? In my understanding, they did not give any definite timeline or period of time for the processing of refunds. No immediate full refund, no interest gained, and the long torturing time of waiting and wondering when our own money would be returned to us, or would it even be returned to us at all. Gosh! too much to bear.

    sa ibang mga buyers na nandito: tonytony, kagebomb, Simba 2011, oninpilotin, kung may ginawa na din po kayong mga legal actions, paki-share nyo na lang po sa iba and sa amin, pede tayong magtulungan sa pagbigay ng kaalaman sa isa't isa. Kung wala pa pong pedeng mag-represent sa inyo at di pa alam ang mga gagawin, our lawyer is willing to help you on your case against this developer. thanks.

    My wife and I bought a unit as well. We asked them if we can resell the unit since it's long overdue. This is what we got as a response from Richard Fernandez.

    Greetings!

    This is in response to your queries which are as follows:
    1. Reselling of your unit
    2. Transfer of Account Process
    3. Refund Process
    With regards to your concerns the following are the response based on the Company Policies:
    1. Technically you cannot resell your unit since it is not yet in your name and you are still in the Payment Process.
    2. Transfer of Account:
    As a company policy we do allow transfer of accounts but limited only to the immediate family members of the Principal Buyer.
    If a qualified new buyer is available the new buyer has to submit a letter of his/her intent that he/she is willing to assume the account as well as for the original buyer as well.
    The amount to be assumed by the new buyer will be subjected to the standard fees and deductions such as Processing Fee; Transfer Fee; and others if applicable.
    Final computation will be processed by the Accounting Department.
    The reservation Fee is non refundable as stipulated in the Reservation Agreement and is therefore forfeited.
    3. As a company policy we really do not have refunds in accordance to the Maceda Law.

    If you have any concerns or reactions please feel free to drop by at our Main office.

    I visited Pan Asia Office in Ortigas last January 2, 2012. I already made my cheques on-hold status since August of 2011.
    I talked with Mr. Fernandez and he said that the first batch of refunds will be sometime in February. Im not sure if this is true but Im hoping. I am very particular about the refund and he said that they have no choice but to give a 100% refund because they are the one who delayed the construction.
    Reading your posts here makes me sad. I dont really know what happened on this project. He keeps on telling me that there are problems with the materials. I doubt.

    yes sir tonytony, sure we can talk. i left my number sa post. it's 09325653929. feel free to post dun sa pinoyexchange posts, tutal wala naman mali and hindi totoo sa mga sinasabi natin. we already filed a formal case against them. if you want to ask for some legal opinions, i can refer to you our lawyer. he handle cases like ours. other buyers who i've come in contact with are also preparing to file charges. pero ang first step na dapat gawin talaga is to write them (Pan Asia) a demand letter. demanding a full refund, kung yun talaga ang gusto nyo. looking forward for more chat. tnx

    hindi sa materials ang reason kung bakit na-delay construction nila, their representative who went to HLURB said that they were not approved with their loans to PAG-IBIG. and the company do not have the means or money to continue the project at the moment. they promised that construction will start again in February but to when will be the turn over date of the units is still uncertain.

    hi rad93! just as i guessed. nagkaproblem sila with Pag-ibig. perhaps their style was like that of Globe Asiatique and nung maghigpit ang Pag-ibig on their policies, isa sila sa naging ''blacklisted'' or something.

    just today i called their Boni office to follow up on the refund schedules. as usual wala na naman ang mga taga-finance. naka-leave ulit yung staff na hinahanap ko. i asked them so meaning walang ngttrabaho sa finance dept nila? anong company yan di ba? walang empleyado? puro mga marketing ang tao don. ang rason nya e ng-aayos daw ng kanilang bagong office na sabi ni Mike sakin nung pumunta ako last last week sa Boni is sa Greenhills daw. ang tagaaaal!!!!! btw, fyi lang for those na nag-iinvest pa, wala pa rin pong pagbabago sa status ng bldg. It's the same as of Sep 2011. As in wala at all at walang gumagawa ng construction. So I wonder pano nila matatapos yun by Oct 2012 as they promised on the letter they sent sa kanilang mga buyers?

    in the end as usual lagi nila sagot is tumawag ako next week. puro sila next week. ok fine. next week dapat may masagot na sila sa refund schedule na yan or else i'll call na your lawyer rad93. kung kailangan pwersahin sila ibalik ang investment natin then pwersahin. i'll ask na for damages. sobrang malaking pahirap ang developer na ito. as if kasalanan nating buyers ang financial problems nila para tayo naman ang pahirapan. sila naman tong posibleng illegal ang Pagibig transactions na ginagawa *** banned sila sa Pagibig.

    Wow, andami na pala naten.. Ako, inistop ko na yung payment since last year pa at hinihingi ko yung remaining PDCs pero hinde pa rin sinosoli kesyo nagppreprepare pa daw yung accounting department or gumagawa pa ng earnings statement for FY2011, then puro update next week na lang daw.. Tsk Tsk.

    Nakakadismaya talaga, sayang yung ininvest na pera hoping na makaka-move in na last 3Q 2011. Kung nasa ibang vehicles yun, kumita pa sana, kahit time deposit lang..

    Pabackground background check pa yung PAGIBIG ng ilang beses, wala din naman pala..

    I'm just wondering, question lang sa may mga lawyers dito, is there any chance na hinde nila maibalik ang pera naten? Like if they declared bankruptcy and magclose yung company nila? What actions can we take?

    @Tafheta, ganyan talaga gagawin nila, mangangako na naman ng panibagong date at terms. kaya, hirap silang unawain. pero sana unawain din nila ang mga unit buyers nila. a lot of these unit buyers have already incurred a big financial loss, not to mention the aggravating emotional stress we're experiencing. Sana maisip nila nakaramihan sa atin ay di naman mayayaman at we are barely making both ends meet. kaya nga tayo nag-invest sa condo para di na umupa ng bahay, tapos ganito pa dadanasin natin sa kanila. Masyado na nilang pinasa ang burden sa mga buyers. dapat silang magkaroon ng accountability sa mga ginawa nila.

    @kagebomb - i think they have no choice but to give us back our money kahit magbankrupt sila. banks nga na nagsasara required na ibalik nila deposits ng depositors e and i know there are certain laws and policies that protect us buyers from such companies.

    @rad93 quoting a part of their ''excuse'' letter:

    "Pan- Asia is just one of the many legitimate developers in the Philippines that have been undergoing difficult times which is normal for any company. The company acknowledges that there have been some minor setbacks in terms of delivery of your units due to some unforeseen circumstances that has befallen our company. We have surpassed these predicaments and are now in the road to recovery. These trials notwithstanding, we assure you of our unwavering commitment to deliver your units.
    The company’s License-To-Sell with Housing & Land Use Regulatory Board (HLURB)is currently being processed for extension."

    The Schedule Resumption of Construction would start on the First (1st) Quarter of 2012 while the New Projected Turnover Date would be on October 2012.

    Pan-Asia International Sunshine Garden Inc. management would like to request for your understanding but we assure you that your investment with Sunshine Garden 2 would be delivered in full as we will honor and stand by our commitment to deliver your unit in accordance with the HLURB required approved plans & specifications


    Well I guess Pan-asia should really stand by their commitment to give us our refunds or else pag umabot sa hlurb and, eventually, sa legal court lahat ng complaints ng buyers nila, malamang hindi na ma-approve ang license nila. They should better not make any empty promises again.

    Oct 2012 turnover? With the current status of the bldg and still no actual construction goin on?!? kahit hindi civil engineer masasabing hindi kaya tapusin yun in 9 months. Talaga atang gusto nila mademanda
