1. If I have paid the AOS and IV fees, does the payment have expiration date?
2. If after I paid the fees and submitted Affidavit of Support but DS-230 has not been submitted within the year from fees have been paid, do I need to re-pay the fees?
Case: NVC sent notification to pay AOS and IV fee. My mother who is in California paid the fees (January 15, 2011) and after one month (February 17, 2011) she submitted Affidavfit of Support Form as requested by NVC. However, DS-230 has not been submitted. Since I will be the one to submit it, I decided to submit DS-230 form with civil documents on February 2012 since I will be returning back to the Philippines next year and my PD is March 2003 pa naman. My question is: Is it possible to submit DS-230 one year after we submitted AOS form? I read kase na within one year after you paid the fees, kelangan makapag-submit ng complete documents and forms or else magbabayad kami ulet ny AOS and IV fees.
Here is their basic policy: If a visa number is available, and if you let one year pass without contacting the NVC, then all fees paid and documents submitted are cancelled.
If a visa number was never available, like we are seeing in so many of these retrogression cases, then the fees that were paid should not be cancelled, even if there was a one year delay in sending in the forms.
BUT- I would not trust the NVC's automated systems to always be correct. They are very fast to send out the cancellation letters that put the cases into the termination process.
SO- The smart thing is to never let a year go by without contacting NVC!
Fee payments, form submission, emails and phone calls are all considered "contacts". Any contact restarts the one-year clock.
preciouscynth, if you want to wait a year to file the DS230, just send them an email now saying you are still collecting documents, or in your case just say you will be filing the DS-230 in February. That will restart the clock and give you a year to file the DS-230 or make some other "contact" with NVC.
