I have a question..,my mother's sister died yesterday and she's the petitioner of my parents... Will their case be affected kahit na hinihintay na lang nila ang schedule of their interview and medical?

Your mother will need to request the petition to be reinstated. There is a lot of good information on this in the Humanitarian Reinstatement thread:

Thanks JA.. so what should be our 1st step? Are we going to report to NVC that my Aunt died? Also regarding AOS of my parents, my Aunt's Daughter is the one sponsored them and were already approved last year by NVC...

correction my Aunt's Daughter is the substitute sponsor when we submitted my parent's AOS last year because my Aunt has no work back then..

JA as I mentioned to you on my previous post, we already finished submitting the AOS and form DS230 and afterwards they replied to us that we'll wait na lang for my parents medical and interview schedule..

So since namatay na yung petitioner ng parents ko, are we going to do yung process ng HR Reinstatement?

wrong timing naman pagkamatay ng auntie mo tartarman. i mean, nag-aantay na lang kayo ng interview and medical, that must be really sad and disappointing. sorry, have no idea about this kind of stuff. goodluck though

i beg to disagree with the above quote. the philippines never recovered after the Marcos's has been thrown out of presidency, mula kay Cory Aquino, Ramos, Estrada, Arroyo, stagnant na ang progress. if only Marcos have not been a power hungry and continued to be a good president, we might be a better country today.
or if the Japanese didn't come to occupy us, we couldn't have resisted the American occupation in our country, we could have been like Puerto Rico or Guam at present day.

    humanitarian reinstatement

hi. i just wanna ask if we con go through humanitarian reinstatement. our category is f4. our priority date is november 4, 1990. i am a derivative of the principal applicant--my father.

    my questions:
    1.
i am already aged-out because i am 21 already, my birthday is novermber 1990.

may i still apply as a derivative of my father?

    2.
my father has just went through a lot of medical treatments because of heart attack and kidney disease. can he go to U.S.? for the reason of health conditions. his sister is a doctor who is also the petitioner.

in case that he would be given a visa, can we still join, with my mother who is his wife. and, if we're given a visa, would be be immigrant visa or just tourist.

thank you. hOping for your reply, especially JA.

First step is to prepare the request to reinstate the petition. Some good ideas in that other thread:

    http://www.pinoyexchange.com/forums/...d.php?t=440431

Normally, the request is sent to the USCIS office that approved the petition, but sometimes you can file the request with USCIS Manila.

All the different titles used for people who sign affidavits of support is confusing, but good to know!

Your aunt was the 'principal sponsor', and her daughter was either the 'joint' or 'co-' sponsor. Now that your aunt has passed, her daughter can now really hold the title of 'substitute' sponsor.

So when you send in the reinstatement request, to keep things simple for CIS, also send in a new affidavit from your aunt's daughter, now with the 'substitute sponsor' box marked on the affidavit.

Sorry robrn, but no, for the reasons in this post: http://www.pinoyexchange.com/forums/...1#post60693891

FB4, so your mother is a derivative on your father's visa. If your father is given an immigrant visa, you mother may also apply with him.

Is it okay if we'll wait for my parents PD to be current and wait for their interview schedule... So during the interview na lang idisclose ng parents ko na yung primary sponsor nila is namatay na.... Because dun sa AOS na sinubmit nila is yung supporting docs is galing lahat sa cousin ko and sya na din yung nakasign dun...

    robrn,

sigurado ka ba in 108 days approved na yung petition ng father mo?

    DOB: 11/29/90
    Class: FB4 Derivative
    PD: 11/4/91
    Pet.App'd: 2/21/92 (Petition was pending 108 days)
    Turned 21: 11/29/2011

coz petitions takes a long time to have it approved, double check mo. pero mukhang malabo ka na kase 1991 pa PD nyo e usad pagong ang PD ng F4.
humanitarian reinstatement are for dead petitioners only, i think. humanitarian parole pag yung mga may sakit yata. kung mayaman naman kayo, try na lang nya mag apply ng B2 medical treatment visa.

    huhuhu

i dont know if its already approved in 108 days, maybe not. it's just that we were so excited before retrogression. we passed and paid all the necessary requirements, i was just 19 turning 20 then, its already qualified but it just waiting for a visa number, it was retrogression's fault. im still a little hopeful.

In the early 1990s, 30-120 days was the normal processing time for family petitions. INS was much more efficient back then.

    bye bye

so, is it already a bye-bye for me? can i refund what i paid for the processing? i think it's 400 to 500 dollars.
