That is true because in my case, although the visa given to me was a CR1 (on account that my USC spouse and I had been married less than 2 years), I did not have to wait for a visa number to be available.

Eligible immediate relatives include the U.S. citizen’s:

    Spouse
Unmarried child under the age of 21
Parent (if the U.S. citizen is over the age of 21)
Immediate relatives have special immigration priority and do not have to wait in line for a visa number to become available for them to immigrate because there are an unlimited number of visas for their particular categories.

Not sure if they would allow him to visit the US since he is already married to the petitioner. Maybe, they could postpone the wedding first, let him apply for a US tourist visa, if approved, he can visit her, then they could get married in the US na lang. Then, if that happens, he could probably stay na lang sa US and wait for his documents to be processed. This is just hypothetical ha. Not sure if this can be done. But I really am sure that if they get married, I doubt that he can just visit her here.

The consul would probably say that they are already married, thus he has to wait for his petition to come through before he can go to the US.

    Just my two cents.

It would probably be best to ask someone like Harley Barrales for a more concrete information.

    Hope this helps.

Thanks for the time and response!

ganito yung scenario nung sa akin... my husband and I got married here in the uk may, 2010. we are planning to move back to the us 2 years from now (hubby's british-american) kung kailangan ng proof of income pano yan wala naman maipapakita pa yung husband ko kasi nga nandito kami sa uk ngayon and sympre pag lumipat kami sa states wala kami parehong work pa dyan. ang ibig ba sabihin nito kailangan mauna siya umuwi sa states and maiwan muna ako dito at pag nakahanap na siya ng work saka lang ako pwede sumunod sa kanya. although may ipon naman kami... sympre hindi kami sure kung enough yun. one more thing... we are planning to stay with my mother-in-law pag balik namin dyan. makakatulong ba yun?

    thanks sa sasagot

hmmm, kung both of you walang work tapos balak kang e petition, pede relatives ng petitioner ang magbibigay ng affidavit of support.

Anyway, in 2 yrs time pa naman so hopefully makahanap na sya ng work. Kung currently may work ang hubby mo dyan sa UK, dapat mag file sya ng ITR for foreign income kahit FICA lang babayaran.

^ thanks for answering my question. pareho kaming may work dito sa uk. mas magiging madali ba kung yung mother-in-law ko mag bibigay na lang ng affidavit of support or mas madali kung mag file na lang siya ng ITR?

  6. #66
may work naman pala si Mr. Its really advisable to file ITR kasi maraming advantage nyan sa future.

Yang Affidavit of support isa lang yan sa requirement. Walang prob yan. I did that to my cousin since both of them are students ng college so wala sila income.

    Hi Missamy!

Before getting married, you must secure a valid marriage license because it is s formal requisite in getting married otherwise, your marriage will be void ab initio. However, the absence of marriage license applies to certain circumstances that fall under Chapter 2 of the New Civil Code of the Philippines.

What is the status of your boyfriend? Is he a US citizen or permanent resident? If you intend to get married in the Philippines, he may file an Immediate Relative (IR-1) or Conditional Relative (CR-1) or K-3 petition on your behalf, if he is a US citizen whereas a family based petition (F-2A) is filed if he is a permanent resident. The number of visas under IR-1, CR-1 and K-3 is not limited each fiscal year as compared to the family-based category.

Here is more information on the poverty guidelines. The 2010 guidelines are the most current ones.

When figuring your household size, make sure to include all of your children who are under 21 and unmarried regardless of whether they live with you.
