I am one of the unit buyers - commercial of Sunshine Garden II in Mandaluyong City. As with any other buyers, we were enticed with the marketing promises. Construction will finish on March 2011 and from there, we can earn the fruits of our investment. We started paying via pre-selling mode since 2009. My husband and I have been waiting since we have projected our business to open by 2nd quarter of 2011. We are paying diligently since we have prioritized this investment for our future. We would visit the site from time to time, like gullible kids awaiting our dream come to reality. Only, we were wondering already since the construction is very slow. However, this last week of March, Pan Asia issued a letter to buyers informing that the condo will be finished on or before the year 2011 ends due to delay in the importation of construction materials! We, and I'm sure other buyers like us are very mad! Does Pan Asia people really think a simple sorry and "on or before the year ends" will be enough to cover up for the losses to the buyers due to this negligence? For commercial investors, this will translate to income losses since we have agreed to buy the unit based on their March 2011 construction finish date. I have talked to a fellow buyer and they have problems as well since they are set to move 1st or 2nd quarter as they will no longer renew their contract in their rented apartment, it is already too costly. Pan Asia, without giving clear commitment on how they will compensate damages to losses incurred by the buyers even had the nerve to say in their letter that they are already planning to build Sunshine Garden 3, as if this will settle everything, the damages and problems they have brought to us. Again, NO clear commitment on how they will compensate damages to losses incurred to us, the buyers since we are the party that was aggrieved. The letter is a big joke and added salt to wounds, so to speak. I have sought help from my lawyer kumpare and his team have their own analysis of what happened, and it's not a good one. Delay in importation of materials would not occur if the management is professional and really knows the consequence problems like this would result. The lack of clear and definite dates in their letter is disturbing. This is a very sad turn of events for buyers like us who invested on real property, only to wake up one day with this kind of problem. Hope this serves as a warning to prospective condo buyers everywhere. Lesson learned: Go for developers that have a well-established reputation. Don't go for pre-selling, invest in RFOs. It makes a great difference in your peace of mind. We are still hoping we can get just and fair resolution to this problem brought about by Pan Asia International developer of Sunshine Garden 2. Also, if there are other people who have the same experience, we appreciate your insights and suggestions. Thank you. God bless.
Simba, I can feel for you but you must know that 95% of construction projects are delayed for a lot of reasons. Even huge and international contractors are experiencing delays. For a 2 year project, a 7 month delay is acceptable.
Again, when the client tells you that the project will finish on a particular date, project a 20% delay.
