    Only few people have the sophistication to identify the features in the compensation plan that assure the money goes mostly to top-of-the-pyramid participants and that the company coffers are enriched at the expense of a continual supply of new recruits who buy products to attempt to move forward, only to quit and be replaced by others who are similarly misled.

    MANILA, Philippines—The Supreme Court has affirmed a Court of Tax Appeals (CTA) decision sentencing multilevel marketer Gloria Kintanar for tax evasion.

    Kintanar, a distributor of direct selling firm Forever Living Products, was meted out two to four years in jail, fined P20,000, and ordered to pay the Bureau of Internal Revenue (BIR) P6.3 million in taxes.

    In a notice sent to the BIR, the high court’s third division informed the agency that a resolution related to the case had been issued as early Nov. 16, 2011. The resolution was signed on Jan. 2 and was received by the BIR on Jan. 24.

    Lucita Abjelina-Soriano, division clerk of court, said the tribunal denied with finality Kintanar’s motion for reconsideration of the CTA decision because “no compelling reason exists and no substantial arguments were raised to warrant its reconsideration.”
    No more pleadings

    Also, the high court resolved that no further pleadings or motions regarding the case would be entertained. In 2005, the BIR filed the case against Kintanar for failing to file her income tax return for 2000 and 2001.

    The BIR said Kintanar earned substantial income as an independent contractor of Forever Living Products Philippines Inc. (FLPPI) and that the agency had asked her several times from 2003 to 2005 to pay her taxes.

    Based on BIR investigation, FLPPI had been paying her commissions for selling its products from 1999 to 2001. Kintanar had cashed or cleared her commission checks at the North Greenhills branch of the Bank of Philippine Islands, where she maintained an account. Kintanar claimed she had entrusted the task of filing her income tax returns to her husband who had, in turn, entrusted the duty to an accountant they hired.

    If you want to be in MLM business, you should at least like the products. Just in case it doesn't work out, you can at least consumed the products. I know we are all in MLM to make money but I have seen so many people fail in this industry. This is not selling. if your trying to sell the product, you are bound to fail. Talk to more people about your opportunity but DO NOT explain the opportunity. let the presentation do the explaining. Think about this, if you do the inviting, explaining, selling, convincing and all of that, that is not duplicable and the person that your trying to recruit cannot do what you just did. Remember, MLM is about duplication, why re-invent the wheel. Imagine going to Mcdonalds and order a meal. The person go to the kitchen, make the burger, fry the potatoes, wrap your burger, get your drink, add the ice, put everything on tray, bring it all to you, get your money and give your order. Do you drink each person can do this? Absolutely Not!! Why? because Mcdonald has a system that is duplicable and it works in every countries. That's why they are successful! I am also in an MLM and my products is being consumed daily in every countries daily. On top of that, its very simple and anyone can do it...

    Interesting Take on MLM

    Guys, here's an interesting take on the matter. The guy talks about MLM for a bit, but focuses on creating VALUE.

    This is something that resonates with me, because I've tried MLM and it didn;t really feel quite comfortable, you know. It DID feel like I was befriending people not to help them, but to get money from them.

    Intention is everything.

    Anyway, this is a good read about that.

    And that is helping them

    This altruistic rhetoric is typical of MLM, and has been overused ad nauseam at least for the 20+ years that I’ve been following the “revolutionary wave” which has been anything but.

    MLM is a flawed system. There are more than enough substantiation and corroboration to support this, and a lot of the issues concerning the operation of MLM have been addressed and discussed here. The vast majority of MLM recruits are struggling simply because the system is flawed. It is inevitable.

    No amount of this “people helping people” hogwash is going to obscure the fact that making money in MLM is not about the effective selling of a product but rather the efficient recruitment and retention of downlines.

    “People helping people” is nothing but a euphemism for recruiting. Quite simply, unless you recruit people, there is no commission money to be made. Forget about retail sales, either. Retail sales of a relatively overpriced product is either too insignificant or practically non-existent.

    Let’s cut the bulsyet. No one gets into MLM because they want to help people. People get in because they are led to believe that there is a significant amount of money to be made. Any MLM’er can be self-aggrandizing about the good and the value that they are bestowing upon their downlines. But, the so-called “help” is an integral and necessary component of the MLM scheme because the fact of the matter is that more recruits in one’s downline equals more commissions. Hypocritical blood-sucking vampires.

    “MLM” is a generic acronym for any type of multi-level or endless chain product distribution program. THE FIVE RED FLAGS of product-based pyramid schemes, or recruiting MLMs:

    1. Each person recruited is empowered and given incentives to recruit other participants, who are empowered and motivated to recruit still other participants, etc. – in an endless chain of empowered and motivated recruiters recruiting recruiters – without regard to market saturation.
    Demonstrates primary income is from recruiting, especially with the features of unlimited recruitment and such powerful incentives to recruit – vs. meager profits from retailing over-priced products. Hyper growth inevitably leads to perceived saturation, which often is followed by a Ponzi move to other markets to repay early investors.

    2. Advancement to your place or level in a hierarchy of multiple levels of “distributors” is achieved by recruitment and/or by purchase amounts, rather than by appointment.
    Demonstrates primary income is from recruiting, since that is the only way to advance in the scheme and to realize major profits. In recruiting MLMs, most recruits are doomed to failure.

    3. “Pay to play” requirements are met by ongoing “incentivized purchases,” with participants the primary buyers.
    Raises breakeven bar, assuring losses for most participants. May place MLM in category of a security or business opportunity – or a de facto investment in a pyramid scheme. Encourages hyper-consumption of products by participants – who are the primary buyers.

    4. Company payout (in commissions & bonuses) per sale for the total of all upline participants equals or exceeds that for the person selling the product – resulting in inadequate incentive to retail and excessive incentive to recruit.
    Removes incentive to do direct selling, since recruiting is potentially many times more profitable.

    5. The MLM company pays commissions and bonuses on more “distributor” levels than are functionally justified; i.e., five or more levels.
    Demonstrates primary income is from recruiting, not retailing. Enhances leverage for top participants who profit hugely, while assuring high loss rate for lower levels. Virtually eliminates retail option, due to high wholesale prices that make direct sales with retail markup difficult. Primary retail target is new recruits – which are making de facto pyramid investments.

    1-5: Combining all five characteristics:
    Results in high loss rates (close to 99.9%) – much higher than for no-product pyramid schemes (87.5% to 93.3%). Strong emphasis on recruiting as the primary source of income, satisfying most statutory definitions of a pyramid scheme. Demonstrates extreme leverage, necessitating fraud and misrepresentation in order to survive and grow.

    I Could Be Shot

    When I hear something like this, it's like the planet has shut.

    While it IS true that a number of MLM companies have a flawed-system, one can NEVER say that the industry itself is flawed.

    You can find a lot who failed in the business. They will mostly tell you how BAD their ex-MLM company was, how they did not get any support at all from their uplines, how they were misled, how they quit.

    Then, there are those who succeed- those who struggled but educated themselves and continue to do so, those who heard enough NOs but stayed in the game. As for me, these are the people I talk to. Not because they are successful but because learning from them will give me both sides of the business.

    See, MLM is a huge industry that's never taught formally. Students don't learn it from school. That's just the way it is. It is an aspect of education that can't be touched.

    This fact leads to ignorance.

    MLM is all about PROMOTING and MARKETING. Helping others is simply a result if these two are done right. Sadly though, 98% of those who join any MLM business do not know how to market and promote the right way.

    You can see it everyday.

    Handling colorful flyers to strangers, cold-calling, pitching people at the park- these used to work 40 years ago. That's right. At one point, these slimy tactics had their fair share of little success.

    What's surprising is, 40 years later, people still expect to reap the same results using the same, old school strategies.

    I can see it everyday and this is what we have to battle against in my primary company. It's extremely hard to change the way people think. Everytime I tell new members or prospects that we will introduce them to a system where they no longer need to drag a stranger in a mall or bug their families and relatives just to introduce their opportunity, it feels like I could get shot for saying it. It takes time to shift traditional thinkers to the modern way of doing business. The only way to speed it up is to let them discover the wonders.

    Before being an internet marketer and networker, I went through a lot myself. The pains that I had were unbearable but those certainly were the foundations of my success.
