ABS-CBN to sue NCAA

Broadcast giant ABS-CBN yesterday expressed alarm over a reported plan by the National Collegiate Athletic Association (NCAA) to cancel its 83rd basketball season after the league’s management committee (Mancom) mishandled its suspension of San Beda player Yousif Aljamal this week.

The Mancom had earlier banned Aljamal for the rest of the season after the Red Lion participated in the Philippine Basketball Association (PBA) rookie draft last week without seeking the league’s permission.

The Mancom, however, reduced the sanction to three playing dates, but not after San Beda management was able to secure a temporary restraining order (TRO) from a Manila court. Also because of this, Mancom was said to be planning to impose a permanent ban on Aljamal while some members have suggested “scrapping” this year’s basketball tournament if the league could not stand the heat of the Aljamal issue.

A ranking league member revealed the plan to several newspapers the other day, but officials from host school Jose Rizal University denied it was ever suggested.

Jose Rizal University and San Beda College are tipped to figure in the NCAA basketball finals. San Beda officials, however, have indirectly accused JRU officials of using their clout as league host in tilting the balance in their favor.

The NCAA has been rocked by many controversies this year, including last month’s arrest of one player and several other personalities for their involvement in illegal gambling activities using the league’s basketball games as their base of operation. A near-brawl also erupted middle of this week between two coaches.

But league problems did not end there as Aljamal’s case has spawned many others, including a possible court case to be filed by ABS-CBN should the league take measures not consonant with its contract with its broadcast arm.

A highly reliable source revealed ABS-CBN executive vice president for sports Peter Musngi, phoned almost all of members of the NCAA policy board verify the planned cancellation of the basketball matches if San Beda seeks a court order to allow Aljamal to play.

School presidents, however, have apparently assured Musngi that everything is under control, but the media executive reminded them the league is under contract with ABS-CBN for five years. The deal was sealed this year and will lapse only after Season 87 in 2011.

Musngi reportedly told the NCAA officials ABS-CBN is also under contract with sponsors and advertisers for the NCAA coverage. There are at least 10 companies advertising on ABS-CBN’s NCAA television coverage which airs Wednesdays and Fridays.

Musngi, however, contested the veracity of the source’s claim, claiming he remains solidly behind every move of the NCAA policy board and the Mancom.

Musngi, who also oversees the coverage of the NCAA’s rival league, University Athletic Association (UAAP), admitted that scrapping the ongoing cage season will deeply hurt business, but he strongly believes the NCAA will overcome this controversy since it is composed of “very respectable people with high moral character.” He said they are still talking right now and it is quite hard to preempt the outcome of their discussion.

No lawsuit will also be filed, not unless the NCAA arrives at something with finality.

“No, that’s not true, I know they will soon come up with a very likely solution to settle this issue,” Musngi said during a phone interview. “I don’t think we should contemplate on doing anything at this point. We’ll just wait and let the Mancom and the policy board to decide.”

With troubles left and right caused by the filing of TROs and on-court brawls and suspensions, ABS-CBN almost withdrew its partnership with NCAA before. But the network held on, something that Musngi is trying to keep until now.

“That’s exactly the same case before, but the league maintained its stand and resolved the problem. I think they will also solve this one,” he said.

Meanwhile, Paul Supan of host JRU finally proceeded to the Manila Regional Trial Court Branch 173 armed with his own set of lawyers to represent the league in its legal tussle with San Beda following the lapse of the 72-hour TRO secured by the Red Lions last Wednesday. The NCAA counsel is composed of two lawyers from JRU, one from San Beda and an independent lawyer, Jose Manuel Diokno.

this issue began with JRU's dirty tactics
after allowing players like Espinas, Najorda, Aban and Bautista to
join the Rookie draft and be drafted in the PBA
despite playing in the NCAA
they blocked Aljamal

San Beda's actions to file a TRO
was our only way to defend ourselves

SBC is preparing to sue the whole NCAA and the trainers and coaching staff involved in the baseless suspension, manhandling of our players in the game... the NBI is now being tapped for a poossible league investigation - from game fixing, conspiracy and the plan to hurt our players...

Of course the bedans showed class. The Red Lions, the gallery, Coach Frankie Lim and his wife, UNTIL the JRU started hurting them intentionally with the blessing of the JRU officials, from their players to their coaches to their Mancom representative Mr. Supan. The Bedans showed class, while the JRU officials did exactly the opposite. Do you know any group of people, or even a country, that were attacked by another country, that just sat there and did not retaliate and just smiled at the other country who attacked them and pretended that nothing happened because they have class?? JRU officials are just a bunch of idiots! When the Germans attacked the Russians, they got surrounded and beaten by Russia's Red Army with the help of its allies.. and when Japan attacked the USA at Pearl Harbor, come game time between us, you can expect the San Beda Community and our Red Lions to make a much bigger impact than the atomic bomb dropped on Hiroshima and Nagasaki on your JRU Bombers.. so big of an impact na magmumuka kayong "watusi" kumpara sa isang atomic bomb sa tabi naming mga bedista..

I feel bad for their students and alumni because they don't know what coming to them, because I'm sure they had no idea what their school officials have planned for the bedans before the games started, which is to hurt them and tried to provoke fights against the bedan players so they can be suspended maybe for more than one game, that they will be suspended two or three games after, that they won't be allowed to play against them sa playoff.

JRU officials probably planned all these before the game started, as JRU being the host, that they will insinuate a fight against the bedan players by giving them unsportsmanlike fouls, fouls so hard and intentional that any player would feel like retaliating or hitting back, but once a player retaliates, that is an automatic ejection and at least a one-game suspension or more, and the JRU player who initiated it would not actually fight back (kasi nauna na sila eh) but would simply get a flagrant foul or an unsportsmanlike foul. The playoffs are here and only a few games away. Imagine if any of the bedans retaliated, and JRU being the host, Mr. Supan on his side have planned to give the San Beda players who would have retaliated more than a one-game suspension, but several games, like at least the next 3 games of the Red Lions, perhaps a suspension that would reach up to the playoffs, like what they initially thought of doing to Aljamal.

That's what they thought they could do, pero nagkamali sila, the Red Lions will be in full force come playoff time... with a vengeance... vengeance with class!

Yup! JRU's head in MANCOM had clearly lied. They reported to the newspapers (philstar.com ata) that they have discussed the option of aborting the whole NCAA games "DURING" the meeting, then when ABS-CBN threatened to sue, informal daw yung discussions nila. Anything that is mentioned "during" any meeting is considered formal specially such subject and mentioning it to reporters and newspapers!

I expect a quick lawsuit on this and a quick outcome.

Malamang umiikot na iyung puwet nung mga iyan, I wonder who will pick up the tab for the P500,000 damages and attorney's fees that SBC is asking for.

In the end, the MANCOM may very well possibly sue JRU just so that they'll have money to pay San Beda.

If I'd had it my way, I'll trade off nu for San Beda to join the UAAP. They are undeniably more cultured and less snooty than nu.

San Beda College caters to some A, and most B & C class students. I'm quite sure na kung sino man ang makatapos sa San Beda eh may magandang kinabukasan.

By the way, I can give you the profile of a bomber woman who sells tilapia in a talipapa in Blumentrit if you like... suki kasi ng katulong namin yun. Masarap at mura ang tilapia na binebenta ni ate Sioning. Bukas baka ipatanong ko kung may Hopia din ba siya... :superevil:

As if the troubles hounding the National Collegiate Athletic Association (NCAA) were not enough, a ranking San Beda College official yesterday bared the school’s possible withdrawal from the league if no solution is found to diffuse the ongoing case involving ace Red Lion Yousif Aljamal.

The official, however, said although “withdrawal is an option, San Beda will still pursue an amicable ending to the Aljamal case,” which started last week after the league’s Management Committee (Mancom) suspended Aljamal for the season for joining the Philippine Basketball Association’s rookie draft without seeking permission from the NCAA.

The NCAA Mancom decision, however, did not hold. First, it reconsidered the season-long suspension of Aljamal, shortening the sanction to three days which wasn’t served still as San Beda was able to secure a temporary restraining order (TRO) from a Manila court.

San Beda is now seeking a permanent injunction, an action which a ranking league official may drive the NCAA to scrap the ongoing basketball season. But ABS-CBN, the league’s television partner, warned against the cancellation of the season, saying the league may face a possible court case if it turns its back on its contractual obligations with the television firm and their sponsors.

While waiting for a permanent order, San Beda just received a 20-day extension of the TRO, allowing Aljamal to play for the Lions for at least three more weeks.

The league has been beset with numerous problems, including illegal gambling where the National Bureau of Investigation (NBI) had arrested a player and several other personalities for running an illegal gambling ring within the league. On and off-court fights are also a common sight in the NCAA. A player was also found to have falsified his records to be able to play.

For these, a San Beda source revealed school officials are not closing their thoughts on the possibility of transferring to another league.

The Tribune source stressed San Beda is willing to leave the NCAA “only after we teach them a lesson that injustice does not pay.” The school’s administrators will meet soon to make a “crucial decision,” but everything still depends on the outcome of their legal tussle against the country’s oldest collegiate league, the source further said.

For the meantime, San Beda is leaving its fate at the hands of the civil court and the seven-man NCAA Mancom headed by Jose Rizal University’s Paul Supan.

“Isn’t it pretty obvious that they will use all means, fair or foul, just to get ahead?” the source, a San Beda hardliner who begged off to be identified, said. “Leaving the NCAA is always an option but not a priority for now. And it will become an option only after teaching them a lesson that injustice does not pay. If they need the courts to do that, so be it.”

Bannered by Nigerian Sam Ekwe and Aljamal, who averages a team-high 15.2 points per game, the Red Lions enjoy a 9-1 mark entering the final week of the two-round elimination. With the way things go, San Beda is heavily tipped to proceed all the way to its second crown in 29 years. The source, however, said even if the resolution of the case would take long, they are willing to wait, before deciding whether they will stay or go.”

“Don’t they know that we’re willing to go (and wait) all the way even after the championship if needed to be?”

A top basketball official also testified on the veracity of San Beda’s possible action, saying leaving the NCAA has been an open-secret in and around San Beda’s Mendiola campus since the controversy started.

“I always hear about the possibility of bolting out of the NCAA, but I do not know where it came from. Maybe it’s true. Your guess is as good as mine.”

Along with Letran, Ateneo, La Salle , Mapua and JRU, San Beda is an original member of the NCAA when the league opened shop 83 years ago.

Fact: Among the member schools of the present day NCAA San Beda is the only remaining founding member. JRU and Letran joined the league in 1927 and 1928 respectively while Mapua joined in 1930...... years after the NCAA was founded in 1924. Konting research naman diyan.

Fact: The REAL founding members of the NCAA in 1924 apart from San Beda are Ateneo, DLSU, UP, UST, UM, NU and FEU's forerunner The Institute of Accounts.

If this reporter were more diligent in writing this article then the public will be able to grasp the gravity of the situation the NCAA faces today and the possible consequence if SBC does decide to leave: THE LEAGUE WILL BE WITHOUT A FOUNDING MEMBER --- what a travesty that would be as the NCAA will then be a league of "sampids".

insecure ka lang sa san beda pre at sa ncaa dahil unti-unti ng bumabangon ang liga.kayo kasi kahit magchampion kayo sa uaap walang makakapansin nyan, wala naman kasing kwentang pagusapan ang school nyo e.

well anyway, it is really sad to see all of these ugly things happening in the NCAA nowadays. if there is only a clear cut rule on NCAA players with remaining year(s) of playing eligibility but decide to join the PBA rookie draft, the crisis engulfing the NCAA would not be happening right now.

sorry to butt in but i hear na that SBC is really considering to pull out of the league, that is all the buzz i heard in the Alumni office last friday, and i think that spells trouble for the NCAA kc, as a i can remember tsinamanph and lion_tamer, san beda was the one responsible in letting the NCAA be televised right correct me if im wrong kc i remember tayo *** host nun. so if BEDA leaves the NCAA sorry NC pero nawalan n *** ng class. And it just shows how bad u handle the situation league pero wlang founding member???? what kind of league is that. absolutely right, liontamer. The writer indeed committed a SLIGHT inaccuracy in the BACKGROUND of his story. However, as highlighted, the factual error was committed not in the body, or what journalists call as the "meat," but in the background. Ergo, the whole story should not be taken as inaccurate by just because of a slight blunder in a sentence used in the background.

Go and tell his editors and publisher about that blunder and, i'm pretty sure, you'll look S-T-U-P-I-D.

Mr. Manicad, i believe and what others have told me, is a budding journalist. He doesn't belong or connected to any NCAA school so we cannot question his integrity in writing his stories. But I think he is better off as a political writer than a sportswriter.

He didn't even mention the fact that Mr. Supan showed up at 8:30am without a lawyer to ask for an extension and that the judge ordered him to get one and return at 2PM. its all good... I have friends from the RED ARMY they are intelligent and highly respectable in their field... they support their LIONS but has respect for the league and its members... Amidst all the controversies they just stayed cool and collected as if saying “whatever happens we will emerge victorious”. Look at what had happened San Beda chose not to play Aljamal for the rest of the elimination. This, my fellow NCAA comrades is not a sign of defeat… This only shows that the Lions have respect for this league. the Lions will not do anything that would harm this league… and in the end the Lions will Stand Tall!. humbleness my friends will bring you Glory..

So it is over. San Beda alread issued a public apology regarding Aljamal's case. I remember last year that Espinas, Aban and Bautista issued a letter to MANCOM that they have the intention to apply for PBA Draft. I hope school officials should also police their own backyard to avoid this incident to happen again. In my opinion both officials have their own shortcomings. San Beda should inform right away that Aljamal is applying for PBA Draft right from the start of his scrimage in the training camp. For sure they know the process since 3 NCAA stars applied for PBA Draft last year.

The MANCOM should get into the picture and act right away. I know they wanted an official document coming from the school that his player is applying in the PBA. The recent event can be avoided if both parties give in. If they knew something about it, they must verify to school officials right away and resolve it ASAP.
