what if nakapagpa-register ka na ng business name pero pagdating sa munisipyo nde ka nabigyan ng business license/permit kasi puno sa location na napili mo *** line of business na gusto mo sana hingan ng permit, pede ka ba mag-operate pa rin kung sole-proprietoship lang naman sya, then home-based lang at mostly online transactions ang dini-deal mo?
kung nde, ano mga consequences nun pag nag-operate ka pa rin nang walang business license/permit.....
please penge advice....... nakaka-frustrate kasi dahil ni-plano ko na sya biglang, whoosh! di na pede! haay :( di naman ako pede lipat ng location dahil wala akong perang pang-rent ng office space....... kaya nga home-based lang sana gusto ko.....

You risk a fine and/or closure of your business if you are caught (http://www.makati.gov.ph/news/news.php?art=516). The fact that you applied for a permit means a record of your intention to operate a business exists in the city government's files. Some money-hungry inspector could one day come across your (disapproved) application and pay you a visit. What will you do if he finds a business there?
I prefer everything to be on the level, but if you really want to operate without permits, it is probably better if the government didn't know about it. In your case, the government already does. :(

kuya danny, actually wala pa akong ni-fill up na forms para sa business permit....... kasi tiningnan lang nila sa munisipyo *** pangalan ng business ko tapos ni-turn down na nila agad................ wala rin akong napansin na ni-log nila un.......
what happend kasi pagdating dun sa isang window sinabihan na ako nung parang teller na kelangan kausapin ko *** parang bosing nila un......... subukan ko raw baka payagan ako......... pagdating ko dun (at after kong maghintay ng pagkatagal-tagal dahil nakikipag-chikahan pa *** bosing sa mga amigas nya) mga 1 minute lang nyang tiningnan business name ko tapos nun sinabihan na nya ako agad na hindi pede...............
makakalusot pa kaya?

A lot of it depends on how you want to run your business.
Are you going to accept correspondence addressed to your business name at your house? What address will you print on your letterhead, official receipts, etc?
Will you put an address in your website?
What if you get sued or some disgruntled customer or supplier decides to report you to the authorities for some other issue not related to your missing business permit?
What if some prospective customer actually likes what you are selling and decided to check you out before placing a big order. Will you risk their looking elsewhere when they associate the presence of your "confidentiality measures" with "fly-by-night business"?
If your business becomes successful, its profile will be raised and the day will come when somebody will ask for copies of the permits. Shouldn't your management time be put to better use making the business earn and prosper, rather than fending off curious people who are there because you did not obey the law?
It might be easier in the long run to find a legal solution, rather than a quick palusot.

zimdude........ un ang pagkakaintindi ko........ may quota sila for that particular line of business........... ang sabi lang sa kin e close na....... nde na sila nagbibigay for my type of business..........

Hindi ko maintindihan ang problem mo. Saan ka ba talaga pumunta? Sa DTI ba? Kung sa DTI ka pumunta at tiningnan ng clerk yung panagalan ng business mo at na reject, ang ibig sabihin nun meron conflict yung pangalan mo with other business. For example, hindi kay pwedeng bumukas ng fishball vendor na pangalan Jolibee.
Kung quota naman, I've never heard of this. You can always try other palusot. Ibahin mo ang category ng business mo pagtapos ibahin mo yung panagalan ng business mo, huwag mong indicate ano ang binebenta mo, generalize it a bit tulad ng "Joey's Marketing" "Joey's General Merchandise".
Whatever you do, I do not recommend you to operate a business without a permit. Lahat ng kita mo, pati capital mo, mawawala lang yan.

jolog1... thanks.... tapos na ako sa DTI, as in approved na business name ko............. sa munisipyo ako nagka-problema, dun sa getting a business permit............ *** sa i-generalize, mukhang di sya applicable sa kin kasi walang inventory involve sa kin, as in wala akong physical goods na binebenta.............

afaik only tricycle franchises are limited. are you plannig to do this. if the municipal says that their quota is filled no choice ka dyan. choose another business. im preatty sure pupuntahan ka nyan nang inspector nag pakilala ka na sa head nila eh. sooner or later they will see you business.

Sometimes, it is not the business that is the problem, but the location. I don't know if it is practical for you, but maybe you can find another address, or another municipality in which to register your business. Since it is mostly internet-based, anyway, the physical address should not matter much, should it?

kuya danny, yes, the address shouldn't matter........... unfortunately, nde lang practical para sa kin lumipat ng location kasi limited resources ko kaya ayoko sana na may mga monthly dues ako for the ofc space ........... ayun :(

wait...sentiments gani2... u have DTI dba? so that means u have a registered busniess...so hnd ILLEGAL un busniess mo ok...u dont need 2 be scared ok...what kinda online buz? online e-commerce site like gift shops?? u jst need 2 talk to right authority maybe those guys jst want sme cash...kse kun approve DTI mo then mayor's permit must be approved on the same address...btw mayor's permit is some sort of taxation ok u pay yearly...kun may DTI ka and ur starting lang its ok...if ur business gets big then jst pay sme1 to do it for u ok...

If the government does not want to help you get into business, why not just go underground instead? The underground economy is a major contributor just like OFW's that has kept our country afloat.
infinity_ph, DTI just provides business name registration. The real business permit comes from the city or municipal hall.

DTI only registers the name of your business, it's not a permit. After DTI, you need to go to barangay for clearance and then go to city hall for business/mayors permit then go to BIR.
Kung tumayo ka ng biz na walang permit, alam agad ng barangay yan kasi kilala nila lahat sa loob ng district nila. Magtataka sila bakit hindi ka humingi sa kanila ng clearance. Strike one. It's also mandatory by law nakadisplay ang BIR plaka mo at mayors/business permit mo sa harap ng store mo. Kung wala yan, strike two. Pagdating ng tax mapping sa area mo, walang ligtas yan. Strike three. What make you think hindi ka susumbong ng competitors mo? alam naman nila siguro max na ang quota diyan no?
Isang huli lang wala na ang business mo. Lubog ka pa sa penalty.

hindi ako sure kung na intindihan ko ng ma asyos yung problem ni scentiments (by the way, are u d one selling scentiments bodymist like angel?). upon reading the whole thread, parang ang problem mo is
DTI approves your business name, pero sa Mayor's permit ayaw? tama po ba ako? am not sure ha, but i think you problem is in the ZONING DEPARTMENT required kasi na magkaron ka ng clearance from that department bago ka mabigyan ng Mayor's Permit. diba sabi mo your business is done at home, pag ang business address mo nasa residential area you need to go to MMDA (Guadalupe), have an approve 20 signatures from your kapitbahay, etc ang purpose nun is para makasigurado sila na hindi makaka distract ang biz mo sa buong barangay/neighborhood nyo. bago ka bgyan ng clearane ng Zoning Dept. ng City Hall. once approved pwede ka ng mag apply for BIR.
... pero pag ang business add mo nasa Commercial place, usually ok na agad sa Zoning Dept. konti na lang yung hinihingi na requirement like letter na nagpapatunay na dun ka nag re-rent, blue print ng building, etc basta kung ano-ano pero madali lang naman
paano ko nalaman yan... heheh ganyan din po naging problem ko bago maitayo ang computer biz namin. :D
